Subject: Resolution to approve an Emergency Finding to allow use of Construction Contractor,
Shoreline Foundation, Inc., for the next segment of the Bicentennial Park Shoreline Stabilization Prot
Purpose of Item:
To request approval of the attached resolution, by a four -fifths (4-5ths) affirmative vote adopting the
City Manager's finding of an emergency, waiving competitive bidding procedures, and approving an
increase in the existing contract with Shoreline Foundation, Inc., for continuation of shoreline
stabilization work and seawall repair for the next segment, in the amount of $3,372,617 from
$6,957,195 to $10,329,812, for the project entitled "Bicentennial Park Shoreline Stabilization Project,
B-30293, formerly B-3293. The Resolution further authorizes an amendment to the March 26, 2003
contract with Shoreline Foundation, Inc. to allow this increase and to provide for subsequent
extensions for future segments of the same work, subject to Commission approval, and to establish
pricing guidelines for potential future work.
Background Information:
On February 26, 2004, the City Commission adopted Resolution No. 04-0107 approving the bid of
Shoreline Foundation, Inc. for the Project entitled "Bicentennial Park Shoreline Stabilization Project,"
B-30293, in an amount not to exceed $6,957,195 from Capital Improvement Project No. 331418.
The Administration has determined that the most expeditious and cost effective method to continue
with the next phase of this project is to utilize the Contractor currently working on the first segment of
the Project. The Contractor, in this instance, is familiar and experienced to undertake and perform the
necessary work because it has an existing contract for the first segment; it is already present and
mobilized on site; it is familiar with the work, the project, and the physical conditions of the site and
the adjacent property; and once a contractor is on board the cost of work can be secured, resulting in a
cost savings to the City. The cost of work for the next segment is justified and competitive at
$3,372,617.
To accomplish this, it is necessary to waive competitive sealed bids as provided under City Code
Section 18-89 and consistent with Florida Statute 255.20. The City Manager has made a written
finding justifying this action.
