A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH
ATTACHMENT(S), ACCEPTING THE BID OF SHORELINE FOUNDATION,
INC. ("SHORELINE"), FOR THE PROJECT ENTITLED "BICENTENNIAL PARK
SHORELINE STABILIZATION PROJECT," B-3293, IN AN AMOUNT NOT TO
EXCEED $6,957,195.10; ALLOCATING FUNDS FROM CAPITAL
IMPROVEMENTS PROJECT NO. 331418, IN THE AMOUNT NOT TO EXCEED
$6,957,195.10, FOR CONTRACT COSTS, PLUS $251,874.05 FOR
ESTIMATED EXPENSES INCURRED BY THE CITY OF MIAMI, FOR A TOTAL
PROJECT COST, IN AN AMOUNT NOT TO EXCEED $7,209,069.15, AS SET
FORTH IN BID DOCUMENT AND THE PROJECT FACT SHEET, ATTACHED
AND INCORPORATED; AUTHORIZING THE CITY MANAGER TO EXECUTE
AN AGREEMENT, IN SUBSTANTIALLY THE ATTACHED FORM, WITH
SHORELINE, FOR SAID PURPOSE; FURTHER AUTHORIZING AN INCREASE
IN THE CONTRACT AWARDED TO EDWARDS & KELCEY, INC., PURSUANT
TO RESOLUTION NO. 03-256, ADOPTED MARCH 27, 2003, FOR THE
DESIGN OF BICENTENNIAL PARK SHORELINE STABILIZATION - PHASE 1I,
PROJECT B-30290 ("PROJECT"), IN AN AMOUNT NOT TO EXCEED $238,101
, INCREASING THE CONTRACT AMOUNT FROM $378,407 TO $616,508, FOR
ADDITIONAL PROFESSIONAL SERVICES REQUIRED FOR THE PROJECT;
AND AMENDING RESOLUTION NO. 03-256 TO REFLECT SAID INCREASE.
WHEREAS, the City of Miami ("City") has engaged the consulting firm of Edwards & Kelcey for
the design of Bicentennial Park Shoreline Stabilization Project, Phase I, B-30290 ("Project"); and
WHEREAS, the City is committed to develop Phase II of the Project, that includes the
stabilization of 695 L.F. of shoreline of Biscayne Boulevard between Bicentennial Park and in the
American Airline Arena; and
WHEREAS, the City received a proposal, in an amount not to exceed $238,101, from Edwards
& Kelcey, for the design of the Phase II of the Project;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The bid of Shoreline Foundation, Inc., in an amount not to exceed $6,957,195.10
, for the project entitled "Bicentennial Park Shoreline Stabilization Project, Phase I, B-3293," is
accepted, with funds allocated, in an amount not to exceed $6,957,195.10, for contract costs plus
$251,874.05 for estimated expenses incurred by the City of Miami, for total project costs in an
amount not to exceed $7,209,069.15, from Capital Improvements Project No. 331418.

Section 2. The City Manager is authorized{1} to execute an agreement, in substantially the
attached form, with Shoreline Foundation, Inc. for said purpose.
Section 3. An increase in the contract awarded to Edwards & Kelcey, Inc., pursuant to
Resolution No. 03-256, adopted March 27, 2003, in an amount not to exceed $238,101, is
authorized, for additional professional services required and Resolution No. 03-256 is amended in
the following particulars:{2}

Section 2. The City Manager's engagement of Edwards and Kelcey, Inc.,
selected from the list of pre -approved engineering firms, approved by Resolution No. 02
-144, is authorized, for design development, preparation of bidding and construction
documents, construction administration consulting services related to the Bicentennial
Park Shoreline Stabilization Project, at specific costs to be determined by (1) the scope
of services required for said project, and (2) terms and conditions set forth in the
agreement executed with Edwards and Kelcey, Inc. pursuant to Resolution No. 02-144,
with funds, in an amount not to exceed $3787407 $616,508 for services and expenses
incurred by the City, allocated from Capital Improvement Project No. 331418, entitled "
Bicentennial Park Improvements."
Section 4. This Resolution shall become effective immediately upon its adoption and
signature of the Mayor.{3}

{1} The herein authorization is further subject to compliance with all requirements that may be
imposed by the City Attorney, including but not limited to those prescribed by applicable City
Charter and Code provisions.

{3} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar
days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall
become effective immediately upon override of the veto by the City Commission.
