SUPPLEMENTARY CONDITIONS: SUBCONTRACTS: The following is added to Section 27 of the General Conditions: Subcontractors: Names of all subcontractors and their current County -Municipal License Numbers shall be listed on the proposal in the spaces provided on Form 00500 (SUPPLEMENT TO BID FORM QUESTIONAIRE). No change in subcontractors, as listed shall be allowed without written permission of the CONSULTANT. Subcontractors shall hold a valid License at the time of executing a Contract. PERMITS, LICENSES AND IMPACT FEES: The following is added to Section 00405, CITY OF MIAMI LICENSES, PERMITS AND FEES. The City of Miami Department of Public Works will issue excavation and tree permits from the Highway/Environmental Engineering Section of the Department of Public Works prior to the start of any construction. All costs for these permits have been included in the administrative costs of this project and the Contractor will not be charged a fee for these permits. UTILITIES: Existing Underground Utilities: Caution shall be exercised by the Contractor in grading operations as some existing underground utilities have only minor cover. The Contractor shall be responsible for replacing any underground facility broken or dislocated during construction for which sufficient underground information has been provided by the utility companies. Any sanitary sewer lines, laterals or storm sewer lines, which were shown on the Contract Documents and/or located in the field, damaged during construction shall be repaired at the Contractor's expense. Underground Gas Pipelines: The Florida Legislature recently passed legislation (CS-645) pertaining to the protection of underground gas pipelines and related facilities. This legislation requires, in part, that persons making excavations in public or private streets obtain information on the location of underground gas pipelines and provide notice of intent to excavate. Further provisions of this legislation include: Requiring the marking of underground gas pipelines by the owner upon notice of intent to excavate; prohibiting the issuance of excavation permits unless such notice has been given; requiring notice of damage to or dislocation of underground gas pipelines City of Miami 106 Bid No. 04-05-011 • • by the excavator; providing for emergency excavation without notice; and prescribing liability of excavator for negligence. COMPLIANCE WITH LAWS: with all Federal, The Contractor shall, in the performance of the work, comply State and Local codes, Ordinances and Regulations pertaining to the work. The Contractor shall be held responsible for any violation of laws or ordinances affecting in any way the conduct of all persons engaged, or the materials or methods used by him on the work. PROJECT SIGNS The following is added to Section 49 Prolect Sign. Unless modified in elsewhere in these Bid/Contract Documents, a sign shall be provided by the Contractor, and placed on the site of the work, at a position designated by the Engineer. This sign shall be neat and of substantial construction, and shall have lettered thereon in a neat and workmanlike manner, the following information: (A) The name or description of the work; (B) The names of the City Commissioners; (C) The name of the City Manager; (D) The name of the Director; (E) The name of the General Contractor; (F) The name of the Director of the Department for whom the project is being built. The Contractor shall provide signs as shown on Misc. 35-89-5. Division 5 - Standards. Payment for signs and their installation shall be considered as incidental to one or more of the bid items and no additional compensation will be allowed. The Contractor shall provide a Construction Sign" required for construction in the public right of way and place on the site of the work at each location where construction is in progress. Sign(s) shall be in accordance with Sketch Misc. 35- 89-5-R attached at the end of this book. The signs shall be constructed of 4'x8'x3/4" exterior plywood, suitably mounted, and readable at eye level. The colors to be used are white and blue. Specifically, the background shall be white; all lettering shall be blue Helvetica. All paints shall be rated outdoor enamel. The "City of Miami" seal will be supplied by the City of Miami 107 Bld No. 04-05-011 Department of Capital Improvements in decal form. The cost of this sign shall be considered as incidental to one or more of the bid items and no additional compensation will be allowed. FINAL CLEANING UP OF RIGHT-OF-WAY The following is added to Section 51, Cleaning Up: Cltv's Right to Clean Up. All trash and other construction debris shall be removed from the job site on a daily basis at no additional expense to the City. Upon completion of the work and before acceptance and final payment shall be made, the Contractor shall clean and remove from the site, the right of way, and adjacent property, all surplus and discarded materials, rubbish, and temporary structures to the satisfaction of the Engineer. equivalent, unless more exactly specified. Contractor shall restore in an acceptable manner, all property, both public and private, which has been damaged during the prosecution of the work; and shall. leave the site and vicinity unobstructed and in a neat and presentable condition throughout the entire area or length of the work under Contract. The placing of materials of any character, rubbish, or equipment, on abutting property, with or without the consent of the property owners, shall not constitute satisfactory disposal. If the work is of such a character as may be done by blocks or sections, the Contractor may be required to promptly remove and dispose of accumulated rubbish, debris, or surplus materials from blocks or sections as completed or partially completed. Furthermore, the construction site shall be left in a condition acceptable to the City inspector where the proper stormwater management methods have been taken to prevent erosion and sediment from impacting the public right of way in accordance with City Code Section 49-4, 49-5 and Department of Public Works Bulletin No. 25. In all cases, the entire extent of the existing storm system (structures and pipes;` within the project limits shall be thoroughly cleaned of all sand, rock and other deleterious materials. The cost of this cleaning shall be included in the Bid price of the new construction and no additional compensation will be allowed. City of Miami 108 Bid No. 04-05-011 • • •
