A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
ACCEPTING THE BID OF METRO EXPRESS, INC., FOR THE PROJECT
ENTITLED "ALLAPATTAH STREET IMPROVEMENTS PROJECT, B-40702," IN
THE TOTAL AMOUNT NOT TO EXCEED $1,761,646; ALLOCATING FUNDS
FROM CAPITAL IMPROVEMENTS PROJECT ("CIP") NO. 341183 IN THE
AMOUNT NOT TO EXCEED $1,200,000 AND THE REMAINING BALANCE IN THE
AMOUNT NOT TO EXCEED $561,646 FOR CONTRACT COSTS, FROM CIP NO.
341330 PLUS $168,481 FOR ESTIMATED EXPENSES INCURRED BY THE CITY
OF MIAMI, FOR TOTAL PROJECT COSTS NOT TO EXCEED $1,930,127, AS SET
FORTH ON THE FORMAL BID DOCUMENT AND THE DEPARTMENT OF
CAPITAL IMPROVEMENTS PROJECT FACT SHEET, ATTACHED AND
INCORPORATED; AUTHORIZING THE CITY MANAGER TO EXECUTE AN
AGREEMENT, IN SUBSTANTIALLY THE ATTACHED FORM, FOR SAID
PURPOSE.
WHEREAS, the Administration has received bids for construction services for the project
"Allapattah Street Improvements Project, B-40702," pursuant to formal invitation for bids dated
December 17, 2004; and
WHEREAS, it is necessary to execute an Agreement, in substantially the attached form, for
said purpose; and
WHEREAS, Metro Express, Inc., is the lowest responsive and responsible bidder pursuant to
formal Invitation for Bids, opened and received by the Office of the City Clerk on January 18, 2005, at
10:00 a,m., in the amount of $1,761,646; and
WHEREAS, funds to cover the total construction cost not to exceed $1,930,127, including the
construction contract, and for expenses and other costs to be incurred by the City of Miami ("City") in
the amount of $168,481, are available from Capital Improvements Project ("CIP") No. 341183 and
341330;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted
by reference and incorporated as if fully set forth in this Section.
Section 2. The bid of Metro Express, Inc., for the project entitled "Allapattah Street Improvements
Project, B-40702," is accepted, in the total amount not to exceed $1,761,646, with funds allocated from
CIP No. 341183, in the amount not to exceed $1,200,000 and the remaining balance in the amount not
to exceed $561,646 from CIP No. 341330 for contract costs, plus $168,481 for estimated expenses
incurred by the City, for total project costs in the amount not to exceed $1,930,127, as set forth on the

Formal Bid Document and the Department of Capital Improvements Project Fact Sheet, attached and
incorporated.
Section 3. The City Manager is authorized{1} to execute an agreement, in substantially the
attached form, for said project.
Section 4. This Resolution shall become effective immediately upon its adoption and signature of
the Mayor.{2}

{1}The herein authorization is further subject to compliance with all requirements that may be imposed
by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code
provisions.
{2}lf the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days
from the date it was passed and adopted. if the Mayor vetoes this Resolution, it shall become
effective immediately upon override of the veto by the City Commission.
