HomeMy WebLinkAboutresolutionCity of Miami Legislation Resolution City Hall 3500 Pan American Drive Miami, FL 3313:3 www.ci.miami.fl.us File Number: 05-00086 Final Action Date: A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AUTHORIZING THE CITY MANAGER TO EXECUTE AN AIRSPACE AGREEMENT AND ADDENDUM TO AIRSPACE AGREEMENT, IN SUBSTANTIALLY THE ATTACHED FORM, WITH THE STATE OF FLORIDA DEPARTMENT OF TRANSPORTATION, FOR THE USE OF RIGHT-OF-WAY PARCEL NO. 0001/ RWMS 1059, LOCATED UNDER 1-95 BETWEEN NORTHWEST 4TH TO NORTHWEST 7TH STREETS, MIAMI, FLORIDA, FOR THE PUBLIC PURPOSE AND USE AS PARKING FOR POLICE AND IMPOUNDED VEHICLES, FOR A FIVE-YEAR PERIOD, WITH AN ANNUAL RENT OF $1.00, WITH ALL TERMS AND CONDITIONS AS MORE PARTICULARLY SET FORTH IN SAID AGREEMENT; FURTHER AUTHORIZING THE CITY MANAGER TO EXTEND SAID AGREEMENT AND ADDENDUM AS NECESSARY, UNDER THE SAME TERMS AND CONDITIONS AS THE AGREEMENT ATTACHED HERETO. WHEREAS, the City of Miami ("City") Department of Police has been utilizing the area under I-95 between Northwest 4th to 7th Streets, Miami, Florida, for several years and has a continuing need for use of this area as an auto pound and parking lot for police vehicles; and WHEREAS, pursuant to Resolution No. 01-404, adopted May 10, 2001, the City Commission approved the installation of a glare screen/screen fence on said property to protect against public view of the site; and WHEREAS, the City Manager administratively approved the installation of lighting improvements in the area with a cost of approximately $31,821 circa October, 2003, to enhance the public utility and use of said property; and WHEREAS, the State of Florida Department of Transportation ("FDOT") is requiring the City to enter into a formal agreement for its continued use of said property, which agreement also approves the improvements made by the City; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Manager is authorized{1} to execute an Airspace Agreement and Addendum to Airspace Agreement ("Agreement"), in substantially the attached form, with FDOT, for the use of right- of-way Parcel No. 0001/RWMS 1059, located under 1-95 between Northwest 4th and Northwest 7th Streets, Miami, Florida, for the public purpose and use as parking for police and impounded vehicles, for a five-year period, with rent at an annual amount of $1.00, with all terms and conditions as more particularly set forth in said Agreement. The City Manager is further authorized to extend said Agreement and Addendum as necessary, under the same terms and conditions as the Agreement attached hereto. Section 4. FERNANDEZ ORNEY r,,) Footnotes: {1} The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted.
