Purpose of Item: To amend Section 18-89(b) of the City Code concerning the applicability of Local Preference, in an effort to stimulate greater competition and to reduce costs for City public works and capital improvement projects. Background Information: For several years, the City has provided a preference to vendors with offices located within the City's jurisdictional limits. The generous preference for construction bids allows a contractor within the City whose bid is within 10% of the lowest bid to accept the contract award at the low bid price. Language in the Code states that this opportunity may be offered at the City's option, but in practice is offered automatically. The result is that many highly qualified and competitive contractors located outside the City no longer bid on City jobs. Additionally, some local contractors given work under this option have had difficulty performing adequately at the lower contract amount, often resulting in change orders and contract increases. During this critical period of peak construction activity within the City and all of South Florida, the City needs to attract top quality and high performing construction contractors. The Administration intends to study similar practices of other governmental entities and return to the City Commission some time in the future with a new provision, more appropriate to the City's needs and industry practice.
