A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
APPROVING THE ALLOCATION OF FISCAL YEAR 2004-2005 HOUSING
OPPORTUNITIES FOR PERSONS WITH AIDS ("HOPWA") PROGRAM FUNDS, IN
THE AMOUNT OF $10,715,000, AND HOPWA PROGRAM CLOSE-OUT FUNDS
FOR FISCAL YEAR 2003-2004, IN THE AMOUNT OF $2,035,495, FOR A TOTAL
ALLOCATION OF $12,750,495, AS SPECIFIED IN "ATTACHMENT A," ATTACHED
AND INCORPORATED, TO PROVIDE HOUSING ASSISTANCE AND HOUSING
RELATED SERVICES TO LOW-INCOME INDIVIDUALS LIVING WITH HIV/AIDS;
AUTHORIZING THE CITY MANAGER TO EXECUTE AGREEMENTS, IN
SUBSTANTIALLY THE ATTACHED FORM, WITH SAID AGENCIES FOR SAID
PURPOSE.
WHEREAS, the Housing Opportunities for Persons With AIDS ("HOPWA") Program was created
under the AIDS Housing Opportunity Act, and revised under the Housing and Community
Development Act of 1992; and
WHEREAS, since 1994 the City of Miami ("City") has received HOPWA Program funds from the
United States Department of Housing and Urban Development ("HUD") and has been responsible for
the implementation of programs designed to provide housing and related services to individuals living
with HIV/AIDS in the City and throughout Miami -Dade County; and
WHEREAS, HUD has advised the City that HOPWA funding, in the amount of $10,715,000, for
Fiscal Year 2004-2005 is available for distribution; and
WHEREAS, HOPWA close-out funds in the amount of $2,035,495 from Fiscal Year 2003-2004 are
available for distribution;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by
reference and incorporated as if fully set forth in this Section.
Section 2. The allocation of Fiscal Year 2004-2005 HOPWA Program funds, in the amount of
$10,715,000, and HOPWA Program close-out funds for Fiscal Year 2003-2004, in the amount of
$2,035,495, for a total allocation of $12,750,495, as specified in "Attachment A," attached and
incorporated to provide housing assistance and housingrelated services to low-income individuals
living with HIV/AIDS, is approved.
Section 3. The City Manager is authorized{1} to execute individual agreements, in substantially the
attached form, with said agencies.

Section 4. This Resolution shall become effective immediately upon its adoption and signature of
the Mayor.{2}
Footnotes:
{1} The herein authorization is further subject to compliance with all requirements that may be
imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter
and Code provisions.
{2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar
days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become
effective immediately upon override of the veto by the City Commission.
