A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
APPROVING THE CITY OF MIAMI ("CITY") LOCAL HOUSING ASSISTANCE
PLAN ("LHAP"), ATTACHED AND INCORPORATED, FOR THE PERIOD OF
JULY 1, 2004, THROUGH JUNE 30, 2007, FOR THE CONTINUED
PARTICIPATION OF THE CITY IN THE FLORIDA STATE HOUSING
INITIATIVES PARTNERSHIP ("SHIP") PROGRAM; CONFIRMING THE USE OF
THE MAXIMUM SALE PRICE DETERMINED BY THE FLORIDA HOUSING
FINANCE CORPORATION'S BOND PROGRAM, CURRENTLY AT AN
AMOUNT NOT TO EXCEED $199,117, FOR A NEW HOME, AND AN AMOUNT
NOT TO EXCEED $173,701, FOR AN EXISTING HOME, FOR THE CITY'S
SHIP PROGRAM MAXIMUM SALE PRICE; CONFIRMING THAT FIVE
PERCENT (5%) OF THE SHIP ALLOCATION PLUS FIVE PERCENT (5%) OF
SHIP PROGRAM INCOME IS INSUFFICIENT TO ADEQUATELY PAY THE
NECESSARY COSTS OF ADMINISTERING THE LHAP; AUTHORIZING THE
USE OF TEN PERCENT (10%) OF THE CITY'S ANNUAL SHIP ALLOCATION
PLUS FIVE PERCENT (5%) OF SHIP PROGRAM INCOME TO COVER
ADMINISTRATIVE EXPENSES ASSOCIATED WITH THE IMPLEMENTATION
OF THE SHIP PROGRAM; AUTHORIZING THE CITY MANAGER TO SUBMIT
A PLAN FOR REVIEW AND APPROVAL BY THE FLORIDA HOUSING
FINANCE CORPORATION; AND AUTHORIZING THE CITY MANAGER TO
EXECUTE ALL NECESSARY DOCUMENTS, IN A FORM ACCEPTABLE TO
THE CITY ATTORNEY, TO IMPLEMENT THE TERMS AND CONDITIONS OF
THE SHIP PROGRAM AND THE LHAP.
WHEREAS, in July 1992, the State of Florida enacted the William E. Sadowski Affordable
Housing Act ("Sadowski Act"), which provides for the allocation of a portion of new and existing
documentary stamp taxes on deeds on real estate transactions to local governments for the
development and maintenance of affordable housing; and
WHEREAS, the Sadowski Act provided a dedicated revenue source for affordable housing and
created the Florida State Housing Initiative Partnership Program ("SHIP"); and
WHEREAS, in August 1994, the City of Miami ("City") was notified by the State of Florida
("State") that the City would be eligible to receive $1,353,387 in SHIP Program funds beginning
with the State's 1995-96 Fiscal Year;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are
adopted by reference and incorporated as if fully set forth in this Section.

Section 2. The City's Local Housing Assistance Plan ("LHAP"), attached and incorporated,
for the period of July 1, 2004 through June 30, 2007, for the continued participation of the City in
the Florida SHIP Program is approved.
Section 3. The use of the maximum sale price determined by the Florida Housing Finance
Corporation's Bond Program, currently at an amount not to exceed $199,117 for a new home, and
an amount not to exceed $173,701, for an existing home, for the City's SHIP program maximum
sale price, is confirmed.
Section 4. The insufficiency of five percent (5%) of SHIP allocation plus five percent (5%) of
SHIP Program Income to adequately pay necessary costs of administering the LHAP, is
confirmed.
Section 5. The use of ten percent (10%) of the City's annual SHIP allocation, plus five
percent (5%) of SHIP Program Income funds to cover administrative expenses associated with the
implementation of the SHIP program, is authorized.{1}
Section 6. The City Manager is authorized{1} to submit the plan to the Florida Housing
Finance Corporation for review and approval and to execute all necessary documents, in a form
acceptable to the City Attorney, to implement the terms and conditions of the SHIP Program and
the LHAP.
Section 7. This Resolution shall become effective immediately upon its adoption and
signature of the Mayor{2}.
Footnotes:
{1} The herein authorization is further subject to compliance with all requirements that may be
imposed by the City Attorney, including but not limited to those prescribed by the City Attorney,
including but not limited to those prescribed by applicable City Charter and Code provisions.
{2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10)
calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it
shall become effective immediately upon override of the veto by the City Commission.
