Public Hearing on CIP Independent Counsel
For February 10, 2005 Commission Meeting
RECOMMENDATION:
It is respectfully requested that the City Commission conduct a Public Hearing at its February
10, 2005 meeting for waiver of the Conflict of Interest provision of Section 2-614 of the City
Code and approving an agreement between the City of Miami and Charles C. Mays Esq. to
transact business with and for the Civilian Investigative Panel (CIP) in the capacity of CIP
Independent Counsel.
BACKGROUND:
On June 24, 2004, the City Commission approved Resolution R-04-0410 authorizing the CIP
to determine in its sole discretion the terms and conditions of employment for its Independent
Counsel. The CIP, after a diligent recruitment, screening and selection process voted
unanimously to appoint Mr. Mays as Independent Counsel subject to City Commission
approval.
Mr. Mays was employed as an Assistant City Attorney for nineteen years until his separation
date of January 14, 2005.
The position is appropriately funded in the CIP Budget for Fiscal Year 2004-2005.
