Re: Appeal of Zoning Board's Decision for Property located at
697 North Miami Avenue, Miami, Florida (the "Property")

Our Firm represents NMA Investments, Inc (' MA") in connection with the captioned
matter. f
On November 8, 2004, the City of Miami Zoning Board (the "Zoning Board") granted
NMA a special exception to allow a night club on the Property. The Zoning oard placed a
condition on the approval that required NMA to appear before the Zoning Board from
now to once again review the special exception (the "Condition").
Pursuant to Sec. 2001 of Zoning Ordinance No. 11000, NMA hereby appeals this
Condition to the City Commission.
NMA states that the Condition is unreasonable, arbitrary, and creates a financial hardship
on NMA.

The Property is currently improved with an old, dilapidated building. NMA is relying on
the special exception approval to obtain financing to remodel and upgrade the building. We
believe that the Condition will prevent NMA from obtaining financing for the improvements.
Finally, the Zoning Board in approving the special exception made a determination that
the nightclub use for the Property was proper. If the use is proper why restrict it in such a
fashion.
The appeal fee was submitted to the City as part of the filing fees for the original special
exception request.
