Miami Avenue CASE NO. 2004-0894 Pursuant to Article 4, Section 401 (Schedule of District Regulations, Permitted Principal Use under the C-1 "Restricted Commercial' of Ordinance 11000, as amended, The Zoning Ordinance of the City of Miami, Florida, the subject proposal has been reviewed to permit a nightclub use at the subject property as follows: The following findings have been made: • It is found that the subject property consists of an existing two-story structure; it is also found that the proposed use is an appropriate adaptive reuse of the existing structure. • It is found that the proposed use is appropriate for this location within the C-1 "Restricted Commercial" district due to its proximity to "Park West Entertainment District" and meaningful ground level pedestrian activity which will benefit the area by having a night club use nearby. • It is found the existing facades are adequately designed, however, signs specifications have not provided to determine aesthetic impact. • It is found that this property was granted a parking variance in September 22nd, 2003 with the conditions. It is also found that the applicant is in full compliance with the conditions of the above mentioned variance (ZB 2003-0758). • It is found that the subject proposal has been reviewed and found in compliance with the criteria as set forth in Section 1305 of Zoning Ordinance 11000. • It is found that upon compliance with the condition set forth below, this project will not have any adverse impacts on the surrounding area. Based on these findings, the Planning and Zoning Department is recommending approval of the application with the following condition: . Paint color samples and sign specifications shall be submitted for review and approval by the Planning Department prior the issuance of any building permit. 2. Approval of this special exception shall run with this operator only; any changes to a different operator shall require a separate Special Exception.
