Dear Mr. Reingold:
RIVERFRONT WEST
1 have received your August 12, 2004 letter concerning an exception to platting
for the Riverfront West project located at 90 S.W. 3 Street and have made the
following determination.
The exception to platting contained in City Code Section 55-10(e) applies to "a
lot, or lots, of record that has been divided into separate parcels, if proof is
submitted that said division was described by deed prior to September 25,
1946 or that said division was approved under zoning regulations in effect
prior to June 27, 1983". Unlike the exceptions provided in City Code Section
55-10(c) for construction of one -family dwellings and 55-10(d) for repair,
remodeling or renovation of existing buildings other than one -family
detached dwellings, the exception to platting contained in Section 55-10(e)
does not apply to unplatted property (property that is not a lot, or lots, of
record).
For this reason, the building site for the Riverfront West project, which
includes an unplatted parcel of land, does not meet an exception to platting
and the recording of a new subdivision will be required in order to obtain a
building permit for new construction on this property. Please be aware that
the developer may continue to process the MUSP plans, any Special Class 1 or
11 permits and building plans review concurrent with the platting procedure.

The final plat must be recorded prior to the issuance of the building permits,
including foundation, for this project.
