HomeMy WebLinkAboutresolutionCity of Miami Legislation Resolution City Hall 3500 Pan American Drive Miami, FL 33133 www.ci.miami.fl.us File Number: 04-01311 Final Action Date: A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), BY A FOUR -FIFTHS (4/5THS) AFFIRMATIVE VOTE, AFTER AN ADVERTISED PUBLIC HEARING, RATIFYING, APPROVING AND CONFIRMING THE CITY MANAGER'S EMERGENCY FINDINGS, WAIVING COMPETITIVE BIDDING PROCEDURES, AND AWARDING A BID TO MCCARTNEY CONSTRUCTION COMPANY, PURSUANT TO SECTION 18-89 OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, FOR THE PROJECT ENTITLED "CITY HALL COMMISSION CHAMBERS LIGHTING, SOUND AND INTERIOR IMPROVEMENTS, B-3285," IN THE TOTAL AMOUNT NOT TO EXCEED $1,155,254; APPROVING AN ADDITIONAL INCREASE IN THE AMOUNT NOT TO EXCEED $3,143.17, FOR A TOTAL CONTRACT AMOUNT NOT TO EXCEED $1,158,397.17; ALLOCATING FUNDS FOR SAID CONTRACT AND INCREASES FROM CAPITAL IMPROVEMENT PROJECT NOS. 311037, 311050 AND 311051; AUTHORIZING THE CITY MANAGER TO EXECUTE THE NECESSARY DOCUMENT(S) FOR SAID PURPOSE. WHEREAS, the City of Miami ("City") needed to renovate and upgrade the City Commission Chambers technologically and aesthetically for television broadcasting and public access to City Commission meetings, and initiated a project entitled "City Hall Commission Chambers Lighting -Sound and Interior Improvements, B-3285" ("Project"); and WHEREAS, at the June 27, 2002, City Commission meeting, Motion #02-759 was passed committing to fund the Project and "directing the City Manager to proceed and move forward" with the design and construction; and WHEREAS, to initiate the Project, the City Manager approved an Emergency Finding dated July 3, 2002, for acquisition of Consultant services, for the advance purchase of lighting, sound and television equipment required for the Project, and for the bidding of the construction work; and WHEREAS, the City Manager subsequently approved a "Supplement" to the Emergency Finding dated July 24, 2002, authorizing an award of a construction contract in the amount of $534,885, to the low bidder, McCartney Construction Company ("McCartney"), with a maximum limit of $600,000, for construction; and WHEREAS, a construction contract with McCartney was initially executed on August 29, 2002, for the scope of work to begin the Project, in the amount of $534,885; and WHEREAS, the City Manager approved another "Supplement" to the Emergency Finding dated November 13, 2002, to increase the maximum limit of the construction contract from $600,000, to $955,769, to cover the cost of code improvements including building, fire protection, electrical, and the Americans with Disabilities Act code improvements; and City of Miami Page I of 3 Primed On: 1/7/2005 File Number: 04-01311 WHEREAS, the City Manager approved an amendment to the contract dated January 29, 2003, to increase the construction contract with McCartney up to a maximum of $250,000, to cover the cost of additional project improvements; and WHEREAS, the construction work under McCartney's contract is now completed and the final cost is under the maximum amount of the increase authorized by the "Emergency Finding Amendment" dated January 29, 2003; and WHEREAS, the current amount of the construction contract with McCartney $1,155,254 and an increase to the contract in the amount of $3,143.17 brings the final cost of the City Hall Commission Chamber and related improvements to $1,158,397.17; and WHEREAS, the actions of the City Manager in approving the foregoing Emergency Findings need to be ratified, approved and confirmed by the City Commission under the Code of the City of Miami, Florida, as amended ("City Code"), and the increase in the contract approved; and WHEREAS, Florida Statute 255,20(c)(5) allows the repair and maintenance of a public facility, which this work is, to be done without formal sealed bidding; and WHEREAS, funds to cover all contract costs have been made available from Capital Improvements Project ("CIP") Nos. 311037, 311050 and 311051 entitled "City Hall Commission Chambers Lighting, Sound and Interior Improvements;" NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section, Section 2. By a four -fifths (4/5ths) affirmative vote, after an advertised public hearing, the City Manager's emergency findings, waiving competitive bidding procedures, pursuant to Section 18-89 of the City Code, awarding a bid to Mc Cartney, for the Project, in the total amount not to exceed $1,155,254, is ratified, approved and confirmed and an additional increase in the amount not to exceed $3,143.17, for a total contract amount not to exceed $1,158,397.17, is approved, with funds allocated for said contract and increases from CIP Nos. 311037, 311050 and 311051. Section 3. The City Manager is authorized{1} to execute any remaining documents necessary for said purpose. Section 4.
