HomeMy WebLinkAboutO-12638City of Miami Legislation Ordinance: 12638 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 04-01414 Final Action Date: 1/13/2005 (4/STHS VOTE) AN EMERGENCY ORDINANCE OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), ACCEPTING A GRANT FROM THE FLORIDA INLAND NAVIGATION DISTRICT ("FIND"), IN THE AMOUNT OF $419,670, FOR THE BICENTENNIAL PARK SHORELINE STABILIZATION - PHASE II PROJECT, B-30290; AMENDING ORDINANCE NO. 12622, ADOPTED DECEMBER 9, 2004, BY APPROPRIATING SAID GRANT FUNDS TO CAPITAL IMPROVEMENTS PROJECT NO. 331418, ENTITLED "BICENTENNIAL PARK IMPROVEMENTS;" AUTHORIZING THE CITY MANAGER TO EXECUTE THE FIND PROJECT AGREEMENT, IN SUBSTANTIALLY THE ATTACHED FORM, FOR SAID PURPOSE. WHEREAS, pursuant to Resolution No. 04-0186, adopted March 25, 2004, the City Commission authorized the City Manager to submit an application to the Florida Inland Navigation District ("FIND") to request grant funding from the Fiscal Year 2005 Waterways Assistance Program in an amount not to exceed $1,550,000, for the Bicentennial Park Shoreline Stabilization Project - Phase II ("Project"); and WHEREAS, Resolution No. 04-0186 also approved the allocation of required matching funds for fifty percent (50%) of the Project, in an amount not to exceed $1,550,000, from anticipated issuance of the second series Homeland Defense/Neighborhood Improvement Bonds previously approved by voter referendum for Capital Improvements Project No. 331418, entitled "Bicentennial Park Improvements;" and WHEREAS, FIND has approved a reduced grant of $419,670, which is to be appropriated into Capital Improvements Program Project No. 331418, entitled "Bicentennial Park Improvements" for B-30290, Bicentennial Shoreline Stabilization Project Phase II ("Phase II"); and WHEREAS, Phase II will contribute to the completion of the seawall replacement along the southern edge of Bicentennial Park that was also funded, in part, by a previous FIND grant, and a new seawall will be constructed along the western and southern edges of the Florida Eastcoast Corridor slip which will allow for tie-in with a public plaza and continuation of the pedestrian promenade; and WHEREAS, the attached FIND Project Agreement provides terms and conditions for the use of FIND funds and reimbursement to the City of Miami ("City") by FIND; and WHEREAS, it will be necessary for the City Manager to accept the grant from FIND and to execute the Project Agreement on behalf of the City for this purpose; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: City of Miami Page 1 of 3 File Id: 04-01414 (Version: 1) Printed On: 10/21/2016 File Number: 04-01414 Enactment Number: 12638 Section 1. The recitals and findings contained in the Preamble to this Ordinance are adopted by reference and incorporated as if fully set forth in this Section. Section 2. A grant from FIND, in the amount of $419,670, is accepted for the Bicentennial Park Shoreline Stabilization -Phase II Project, B-30290. Section 3. Ordinance No. 12622, the Capital Projects Appropriations Ordinance, adopted December 9, 2004, is amended in the following particulars:{1} "Ordinance No. 12622 Section 1. The herein appropriations are made for implementation of all municipal capital improvements of the City of Miami, including new capital improvement projects scheduled to begin during Fiscal Year 2005. The herein appropriations which are designated by reference to descriptive project title and number also include appropriations for previously approved scheduled projects as well as reappropriations of prior funds. The sources of revenues to support the herein appropriations are identified by fund and project in ten Capital Funds, as follows: "Appropriations VI. Fund 331 Parks & Recreation 38. 331418 Bicentennial Park Improvements Funding Source: a. Homeland Defense/Neighborhood Improvement Bonds $ 6,170,000 b. Florida Inland Navigation District 700,000 1,119,670 c. 1-95 Pedestrian Overpass 168,400 d. 1-95 Pedestrian Overpass - Interest 20,438 e. Contribution from FY 2003 General Fund 1,200,000 f. Donation from 360 Developers, LLC 18,225 g. Homeland Defense/Neighborhood Improvement Bonds - Interest 2,000,000 h. Contribution from FY 2004 General Fund 900,000 Total $ 11,177,063 $ 11,596,733 *1I Section 4. The City Manager is authorized{2} to execute the FIND Project Agreement, in substantially the attached form, for said purpose. Section 5. All ordinances or parts of ordinances insofar as they are inconsistent or in conflict with City of Miami Page 2 of 3 File Id: 04-01414 (Version: 1) Printed On: 10/21/2016 File Number: 04-01414 Enactment Number: 12638 the provisions of this Ordinance are repealed. Section 6. If any section, part of section, paragraph, clause, phrase or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Section 7. This Ordinance is declared to be an emergency measure on the grounds of urgent public need for the preservation of peace, health, safety, and property of the City of Miami, and upon further grounds of the necessity to make the required and necessary payments to its employees and officers, payment of its debts, necessary and required purchases of goods and supplies and to generally carry on the functions and duties of municipal affairs. Section 8. The requirement of reading this Ordinance on two separate days is dispensed with by an affirmative vote of not less than four -fifths of the members of the Commission. Section 9. This Ordinance shall become effective immediately upon its adoption and signature of the Mayor.{3} Footnotes: {1} Words and/or figures stricken through shall be deleted. Underscored words and/or figures shall be added. The remaining provisions are now in effect and remain unchanged. Asterisks indicate omitted and unchanged material. {2} The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code Provisions. {3} This Ordinance shall become effective as specified herein unless vetoed by the Mayor within ten days from the date it was passed and adopted. If the Mayor vetoes this Ordinance, it shall become effective immediately upon override of the veto by the City Commission or upon the effective date stated herein, whichever is later.
