TO: CITY OF MIAMI, a municipal corporation
With the understanding that this Opinion of Title is furnished to the CITY OF
MIAMI, FLORIDA, in compliance with Section 55-8 of the Miami City Code and as an
inducement for acceptance of a proposed final subdivision plat covering the real property
hereinafter described. It is hereby certified that I have examined the complete Abstract of
Title completely covering the period from the beginning to October 19, 2004 at 6:00
A.M., inclusive of the following described real property:
The West 45 feet of Lot 1, less the South 10 feet thereof, the West 45 feet
of Lot 2, the East 20 feet of Lot 22, all of Lot 23, all of Lot 24, the South
130 feet of Lot 25 and the South 130 feet of Lot 26, all in Block 9, of the
REVISED PLAT OF GRAPELAND, according to the Plat thereof, as
recorded in Plat Book 3, Page 196, of the Public Records of Miami -Dade
County, Florida.
Basing my opinion on said complete abstract covering said period I am of the
opinion that on the last mentioned date the fee simple title to the above described real
property was vested in:
FLORIDA POWER & LIGHT COMPANY, a Florida Corporation
Subject to the following encumbrances, liens, and other exceptions:
GENERAL EXCEPTIONS
1. All taxes for the year 2005 and subsequent years.
2. Rights of parties in possession other than the above owner.
3. Facts that would be disclosed by an accurate survey.
4. Any unrecorded labor, mechanics' or materialmens' liens.
5. Zoning and other restrictions imposed by governmental authority.
SPECIAL EXCEPTIONS
1. Mortgage And Deed of Trust from Florida Power & Light Company, a Florida
corporation, to Bankers Trust Company and The Florida National Bank of
Jacksonville, as Trustees, dated January 1, 1944, recorded January 14, 1944,
in Mortgage book 1462, Page 423, of the Public Records of Miami -Dade
County, Florida, as supplemented.
2. Agreement For Water And Sanitary Sewage Facilities Between Miami -Dade
County And Florida Power & Light Company, dated July 22, 2004, recorded
August 5, 2004, in Official Records Book 22545, Page 1745, of the Public
Records of Miami -Dade County, Florida.
NOTE: Pursuant to and in compliance with the Mortgage And Deed Of Trust,
the Co -Trustee resigned effective September 2, 1992, and all the right, title
and powers of the Trustees under the Mortgage are now held by DEUTSCHE
BANK TRUST COMPANY AMERICAS (formerly known as BANKERS
TRUST COMPANY).
Therefore, it is my opinion that the following parties must join in the platting of
the above described real property in order to grant CITY OF MIAMI, FLORIDA and the
public, a good and proper title to the dedicated areas shown on the final plat of the
aforedescribed property, the subdivision thereof to be known as F.P.L. Grapeland
Substation Plat.
