Subject: Resolution to ratify amendments. and allocate grant funds for the Pinehurst Stormwater
Drainage Project and Flagami, West End and Fairlawn Projects

Ratification of Amendment Nos. 1 and 2 for the Agreement between the City and the South Florida
Water Management District (SFWMD) for the Pinehurst Stormwater Drainage Project and Flagami,
West End and Fairlawn Projects; and authorization to allocate grant funds, in the amount of $750,000,
to Capital Improvement Project No. 352191 entitled "Pinehurst Storm Sewers" for B-50683 Pinehurst
Storm Sewer Retrofitting.
Background Information:
On March 7, 2002, Resolution No. 02-257 was adopted and passed by the City Commission accepting
a grant in the amount of $1,250,000, from the South Florida Water Management District for a
drainage system and flood mitigation project in the Flagami neighborhood.
On March 14, 2002, Resolution No. 02-257 was amended by Resolution No. 02-328 to include
$6,230,000 matching funds contingent upon receiving funds from the Federal Emergency
Management Agency (FEMA) 404 Hazard Mitigation Program.
Due to tight deadlines required by SFWMD and to avoid expiration of the Agreement, Amendment
Nos. 1 and 2 were executed by the City Manager without approval by the City Commission . When
Amendment No. 2 was presented to the City Attorney's Office for review and approval it was brought
to the Department's attention that these amendments needed to be approved by the City Commission
and the Department was advised to have both amendments ratified.
The amendments extended the period of performance by a total of forty-five (45) months, increased
the agreement amount by $750,000 to a total of $2,000,000, amended the statement of work to include
the Pinehurst Stormwater Drainage Project, and revised the payment and deliverables schedule.
