NUISANCE ABATEMENT BOARD
ANNUAL REPORT 2004
The Nuisance Abatement Board (NAB) was created in 1991 as a "quasi-judicial
forum to resolve controversies over the existence of public nuisances, such as
violative use of property in Miami, where crimes, crime -related conduct, annoying
and/or injurious use of property flourish" and as specifically defined in Chapter 46
Public Nuisances of the Code of the City of Miami. The NAB is dutifully serving
its purpose by alleviating public nuisances and addressing community complaints
within the City of Miami.
Is the board serving the purpose for which it was created?
Yes.
Is the board serving current community needs?
The NAB is working diligently with the City of Miami Police Department and all
NET Administrators in an effort to rid the City of public nuisance activities; in
addition, the NAB maintains an open-door policy by encouraging the City of
Miami residents to report nuisance activities because they are vital to the
successful operation of the Board. The Board offers the following to citizens and
businesspersons to express their needs, concerns, suggestions and complaints:
• Community Concerns: Residents who attend the monthly hearing are
encourage to express their concerns in person.
A list of the board's maior accomplishments:
Volume of cases: The NAB held seven hearings in 2004 and in these meetings,
three cases were scheduled. In an effort to increase the nuisance abatement the
number of cases and to further rid the City of nuisance activities, the NAB
chairman and our legal council are meeting with the police commanders and
NRO's to resolved any difficulties or misunderstandings that may exist; in
addition, the Nuisance Ordinance was recently amended to make it easier for the
police and the City's citizens to bring cases before the Board.

The NAB serves as a leader .and a model for numerous Boards; therefore, no
existing boards, public or private, would better serve the function of the NAB.

The NAB serves as a goaei judicial. forum inwhich controversies over the
existence of public nuisances may be solved in the -public interest with due
process of law. This Board shall consist of fiver Indiveluats who reside, own real
property or maintain a businessoffice within the City of 'Miami and who are
appointed by the City- Commission: Ali members shair serve a term of one year
or until the nominating Commissioner leaves office, whichever occurs first. Each
City Commissioner shalt nominate once member for appointment to the Board.
The City Commission may reappoint any member not more than six consecutive.
terms. Appointments to tilt a vacancy shall be for the remainder of the unexpired
term.
