HomeMy WebLinkAboutlegislationCity of Miami Legislation Ordinance City Hall 3500 Pan American Drive Miami, FL 33133 www.ci.miami.fl.us File Number: 04-01233 Final Action Date: AN ORDINANCE OF THE MIAMI CITY COMMISSION SUNSETTING THE FOLLOWING BOARDS: BROWNSFIELDS ADVISORY BOARD, THE ECONOMIC DEVELOPMENT FINANCING AUTHORITY, THE INDEPENDENT COMMUNITY REDEVELOPMENT AGENCY, THE UNITED STATES HOUSING AND URBAN DEVELOPMENT FUNDING POLICY, PROGRAM AND PROCEDURES REVIEW COMMITTEE, THE PROPERTY AND ASSET REVIEW COMMITTEE, THE LITTLE HAVANA FESTIVAL COMMITTEE AND THE AFFORDABLE HOUSING ADVISORY BOARD; MORE PARTICULARLY 8Y AMENDING CHAPTERS 2, 18, 14 AND 54, OF THE CODE OF THE CITY OF MIAMI, FLORIDA , AS AMENDED, AS STATED HEREIN; CONTAINING A REPEALER PROVISION, A SEVERABILITY CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE. BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The Brownsfield Advisory Board is sunsetted and Chapter 2/Article XI/Division 9/ Sections 2-1121- 1134 are repealed in its entirety to effect said sunset. Section 2. The Economic Development Financing Authority is sunsetted and Chapter 18/Article XI Divisions 1-4/Sections 18-556-620 are repealed in its entirety to effect said sunset. Section 3. The Independent Community Redevelopment Agency and U.S. Housing and Urban Development Funding Policy, Program and Procedures Review Committee is sunsetted and Chapter 14/Article V/Divisions 1-3/Sections 14-300-304 and Division 4/Section 14-311 are repealed in its entirety to effect said sunset. Section 4. The Property and Asset Review Committee is sunsetted and Chapter 2/Article XI/ Section 2-779 is repealed in its entirety to effect said sunset. Section 5. The Little Havana Festival Committee is sunsetted and Chapter 54/Article XII/Sections 54-441-444 are repealed in its entirety to effect said sunset. Section 6. The Affordable Housing Advisory Board, created pursuant to Ordinance No. 11253, is sunsetted. Section 7. Chapter 2/Article XI/Division 2/Section 2-892 of the Code of the City of Miami, Florida, as amended, is further amended in the following particulars:{1} City of Miami Page 1 of 4 Printed On: 11/4/2004 File Number: 04-01233 "Chapter 2 ADMINISTRATION * Article XI. Boards, Committees, Commissions * * DIVISION 2. Standards for creation and review of boards generally * Sec. 2-887. Quorum requirements; exceptions. * (b) The following boards are subject to quorum requirements as provided for elsewhere in this Code. Audit Advisory Committee Bayfront Park Management Trust * * * Sec. 2-892. "Sunset' review of boards. Commencing with the year 1995, each city board shall be reviewed in the following manner: * * (4) The following boards shall initially be reviewed in the following years and shall be reviewed every four years thereafter: * * * d. 1998: 1. Historical and environmental preservation board. 2. Health facilities advisory board. 3. Chapter 14/Article V/Division 4/Section 14-310 of the Code of the City of Miami, Florida, as amended, is further amended in the following particulars:{2} "Chapter 14 DOWNTOWN DEVELOPMENT * ARTICLE V. SOUTHEAST OVERTOWN/PARK WEST REDEVELOPMENT DISTRICT AND COMMUNITY REDEVELOPMENT AGENCY * * DIVISION 4. FUNDING, EVALUATION AND REVIEW OF COMMUNITY REDEVELOPMENT AGENCIES * * Sec. 14-310. Funding. Commencing in fiscal year 2000 and continuing through and including fiscal year 2004, the city shall, in addition to the proposed funding allotted to the CRAs as part of the five- year plan, shall allocate additional funds, subject to the availability of funds and subject to annual appropriation approvals, to the CRAs, in the amount of $5,000,000.00 annually, the $4,000,000.00 of which shall be dedicated by the CRAs for operational expenses, and $1,000,000.00 of which shall be dedicated by the CRAs for administrative costs annually; providing, however, said funds are utilized in accordance and compliance with all applicable state and federal laws. funds." Section 9. All ordinances or parts of ordinances that are inconsistent or in conflict with the provisions of this Ordinance are repealed. Section 10. If any section, part of section, paragraph, clause, phrase or word of this Ordinance is City of Miami Page 3 of 4 Printed On: 11/4/2004 • File Number: 04-01233 declared invalid, the remaining provisions of this Ordinance shall not be affected. Section 11. It is the intention of the City Commission that the provisions of the Ordinance shall become and be made a part of the Code of the City of Miami, Florida, as amended, which provisions may be renumbered or relettered to accomplish such intention. Section 12. This Ordinance shall become effective thirty (30) days after final reading and adoption thereof.{3} APPROVED AS TO FORM AND CORRECTNESS JOR : L.
