AN ORDINANCE OF THE MIAMI CITY COMMISSION, AMENDING ORDINANCE
NO. 11000, OF THE ZONING ORDINANCE OF THE CITY OF MIAMI, FLORIDA, BY
AMENDING ARTICLES 4 AND 9, IN ORDER TO MODIFY CONDITIONAL
PRINCIPAL USES IN THE C-1 AND C-2 ZONING DISTRICTS AND TO MODIFY
PROVISIONS OF SECTION 945, PHARMACEUTICAL LABORATORIES, TO BE
CONSISTENT WITH SUCH CHANGES; CONTAINING A REPEALER PROVISION
AND A SEVERABILITY CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the Miami Planning Advisory Board, at its meeting on October 6, 2004, Item No. 5,
following an advertised hearing, adopted Resolution No. PAB 114-04 by a vote of seven to zero (7-0),
RECOMMENDING APPROVAL of amending Zoning Ordinance No. 11000, as hereinafter set forth;
and
WHEREAS, the City Commission after careful consideration of this matter deems it advisable and
in the best interest of the general welfare of the City of Miami and its inhabitants to amend Ordinance
No. 11000 as hereinafter set forth;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Ordinance are hereby
adopted by reference thereto and incorporated herein as if fully set forth in this Section.
Section 2. Ordinance No. 11000, as amended, the Zoning Ordinance of the City of Miami, Florida, is
hereby amended by amending the text of said Ordinance as follows: {1}
"ARTICLE 4. ZONING DISTRICT
Section 401. Schedule of District Regulations"
C-1 Restricted Commercial.

22. Pharmaceutical laboratories only by Special Exception subject to criteria, requirements and

limitatio-Rs set forth in Section 945.
23 22. Processing, packaging, handling, distribution and wholesale and retail sales of seafood by
Class II Special Permit only and only when such uses are conducted from properties which
immediately abut the Miami River. The Class II Special Permit shall ensure compliance with the
general and special considerations outlined in Section 604.3.2.
24. 23. Sales of fresh flowers from mobile vending carts placed in open space areas by Class II
Special Permit and subject to compliance with Coconut Grove Right -of -Way Vending Cart Guides and
Standards.
25. 24. Fire stations, subject to Special Exception with City Commission approval.
C-2 Liberal Commercial.
Conditional Principal Uses:
17. Pharmaceutical laboratories only by Special Exception subject to criteria, requirements and
limitations set forth in Section 945.
Article 9. GENERAL AND SUPPLEMENTARY REGULATIONS.
Sec. 945. Pharmaceutical laboratories.
The following general standards, limitations and requirements shall apply to pharmaceutical
laboratories in the C 1 G/I, C-2 and I districts:
945.1. Pharmaceutical laboratories, intent. Pharmaceutical laboratories are facilities equipped and
intended for the testing of pharmaceutical products, particularly their effects on the human body. Due
to the standard protocols associated with such research, test subjects must at all times remain on -site
for prolonged periods including overnight stays.
945.2. Pharmaceutical laboratories, where allowed. Pharmaceutical laboratories shall be allowed as
permitted principal uses in G/I Governmental and Institutional zoning districts, subject to the
limitations herein.
Pharmaceutical laboratories shall be allowed as conditional principal uses in C 1 Restricted C 2
General Commercial and I Industrial zoning districts by Special Exception.

Section 3. All ordinances or parts of ordinances insofar as they are inconsistent or in conflict
with the provisions of this Ordinance are hereby repealed.
Section 4. If any section, part of section, paragraph, clause, phrase or word of this Ordinance is
declared invalid, the remaining provisions of this Ordinance shall not be affected.
Section 5. This Ordinance shall become effective thirty (30) days after final reading and adoption
thereof. {2}

{2} This Ordinance shall become effective as specified herein unless vetoed by the Mayor within ten
days from the date it was passed and adopted. If the Mayor vetoes this Ordinance, it shall become
effective immediately upon override of the veto by the City Commission or upon the effective date
stated herein, whichever is later.
