The Code Enforcement Board was created to issue orders having the force of law commanding
whatever steps are necessary to bring a Code violation into compliance.
Florida Statutes Section 162.05(2) requires members of the Code Enforcement Board to be
residents of the City of Miami. City Code Section 2-812 states that whenever possible, the
board is to consist of an architect, a businessperson, an engineer, a general contractor, a
subcontractor, and a realtor.
Two appointments are needed at this time:
• Vice Chairman Gonzalez has one nomination for regular seat currently held by Richard
Tapia, who has exceeded the number of absences allowed per City Code.
• The Commission At -Large has one appointment for alternate seat currently held by
Anthony Cantey, who cannot serve because he has been appointed as a member of the
Nuisance Abatement Board. The Code Enforcement Board and Nuisance Abatement
Board are quasi-judicial and have enforcement powers. Thus, a person should not be
sitting on both boards.
For your convenience, we have included a copy of the current membership of said board. By copy
of this memorandum, we are requesting the Agenda Office to place this issue on the December 9,
2004 Commission agenda. This issue was deferred from the November 18, 2004 Commission
meeting.
