HomeMy WebLinkAboutR-04-0774City of Miami Legislation Resolution: R-04-0774 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 04-01291 Final Action Date: 12/9/2004 A RESOLUTION OF THE MIAMI CITY COMMISSION AUTHORIZING THE CITY MANAGER TO CREATE A CITY OF MIAMI ("CITY") LOCAL MITIGATION STRATEGY PROCESS TO IDENTIFY AND PRIORITIZE PROJECTS THAT SERVE TO MITIGATE THE RISK AND THREATS BY FACILITATING STATE AND FEDERAL FUNDING FOR CITY INITIATIVES IN CONNECTION WITH THE MIAMI-DADE COUNTY LOCAL MITIGATION PLANNING INITIATIVE AND THE COMMUNITY RATING SYSTEM FOR NATIONAL FLOOD INSURANCE; DIRECTING THE CITY MANAGER TO UNDERTAKE THE NECESSARY RELATED PROCEDURES AND TO PROVIDE ANY NECESSARY DOCUMENTS AND AGREEMENTS FOR EACH PROJECT TO THE RISK MANAGEMENT ADMINISTRATOR AND THE CITY ATTORNEY FOR PRIOR REVIEW, FOR SAID PURPOSES. WHEREAS, pursuant to Resolution No. 99-658, adopted September 21, 1999, the City of Miami ("City") has a need to create a Local Mitigation Strategy ("LMS") process to identify and prioritize projects that serve to mitigate the risk and threats by facilitating State and Federal funding for City initiatives and to facilitate the City's participation in the Community Rating System for the National Flood Insurance Program ("CRS/NFIP"); and WHEREAS, this process will include the creation, publishing updates, public meetings and town hall meetings to incorporate public participation in the awareness and formulation of the City's LMS and CRS/NFIP; and WHEREAS, the City's LMS will function in support of the Miami -Dade County ("County") and State of Florida ("State") LMS program and the United States Government ("Federal") CRS/NFIP; and WHEREAS, projects included in the City LMS will be forwarded on a cyclical basis to be added to the lists for the County and State LMS program and the Federal CRS/NFIP for inclusion for funding for both programs; and WHEREAS, inclusion of these projects in the City LMS will be incorporated in the County and State LMS and the Federal CRS/NFIP and will satisfy the eligibility for funding of the State and Federal LMS and CRS/NFIP; and WHEREAS, adherence will facilitate State and Federal funding by complying with the State and Federal LMS and CRS/NFIP requirements; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. The City Manager is authorized{1} to create a City LMS process to identify and prioritize projects that serve to mitigate the risk and threats by facilitating State and Federal funding for City initiatives in connection with the County Local Mitigation Planning Initiative and the Federal CRS/NFIP. Section 3. The City Manager is directed to undertake the necessary related procedures and to provide any necessary documents and agreements for each project to the Risk Management Administrator and City Attorney for prior review, for said purposes. Section 4. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.{2} Footnotes: {1} The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
