HomeMy WebLinkAboutAnalysisANALYSIS FOR VARIANCE 1252 SW 22nd STREET Case No. 2004-0828 Pursuant to Section 401 of Ordinance 11000, as amended, The Zoning Ordinance of the City of Miami, Florida, the subject proposal has been reviewed for a Variance as follows: Variance for parking: Required - 15 spaces Provided - 4 spaces Grand fathered - 5 spaces Request to waive -10 spaces The following findings have been made: • It is found that the subject property consists of an existing legal nonconforming structure with four (4) parking spaces on site and it is also found that the proposed bar uses is grand fathered with five (5) parking spaces for the same use before. • It is found that the proposed use is appropriate for this location within the SD-13 "Coral Way Special Overlay District" area. • It is found that while there is only four (4) parking spaces onsite, the parking demands will be met by existing nearby metered parking along SW 22nd Street (Coral Way). • It is found that the proposal complies with the hardship criteria, which justifies the requested variance; it will not have an adverse effect on the adjacent area due to the particular nature of the proposed use, specifically the bar, is going to be used during evening hours when there is plenty of parking available in the area. • It is found that the grant of this variance, for the specific uses that the applicant is requesting, is in harmony with the general intent and purpose of the Zoning Ordinance and is not injurious to the neighborhood upon compliance with the conditions set forth below. Based on these findings, the Planning and Zoning Department is recommending approval of the requested parking variance for the proposed use with the following conditions: . if the structure for which the variance is granted terminates for any reason (including an act of God) the variance shall terminate. 2. Recordation of these conditions in the Public Records (after review and approval from City Attorney's Office) at the expense of the applicant prior to the issuance of a building permit.
