Thompson, City Clerk SUBMITTED IN TO THE PUBLIC RECORD FOR ITEMPZ. 1 ON i 0 4- 00953-P"aerni;tini- City Commission Verbatim Minutes October 14, 2004 D3.2 04-01160 DISCUSSION ITEM DISCUSSION CONCERNING A MOTION TO RECONSIDER ITEMS PZ 26 AND PZ 27 FROM THE SEPTEMBER 27, 2004 MEETING AND DIRECTING THE EXECUTIVE SECRETARY OF HEARING BOARDS, THE DIRECTOR OF PLANNING AND ZONING AND ANY OTHER APPROPRIATE MEMBERS OF THE ADMINISTRATION TO RE -ADVERTISE AND RE-EXAMINE THESE ITEMS FOR A FUTURE PLANNING AND ZONING AGENDA. MOTION A motion was made by Chairman Sanchez, seconded by Commissioner Regalado, and was passed unanimously, to reconsider the following Planning and Zoning Items from the September 27, 2004 agenda: Items PZ.26 and PZ.27, which items were denied on first reading, related to zoning change at approximately 2143 and 2161 S.W. 6 Street and 2161 S.W. 5 Street; and Items PZ.20 and PZ.21, which items denied permission to allow a bar and to waive ten (10) of the required fifteen (15) parking spaces, four (4) spaces provided for the property located at approximately 1252 Southwest 22nd Street; further directing the Executive Secretary of Hearing Boards, the Director of Planning and Zoning and any other appropriate members of the Administration to re -advertise and re-examine these items for a future planning and zoning agenda. Vice Chairman Gonzalez: Mr. Chairman, you're recognized Chairman Sanchez: Yes. I have an item for — a discussion item on D3.2, which is a motion to reconsider items that were on the last PZ (Planning & Zoning) Commission meeting. It was PZ. 26, PZ27 from -- and 1 believe it was September the 27th when we had the meeting. Also, PZ. 20 and 21, I would like to make a motion to reconsider, and all this basically does is that it opens the door to a rehearing down the road, once it has been properly readvertised and it'll be placed on the PZ agenda and be brought back with the proper application, and with any modification that has been made on those items and you know, of course, it will be evaluated by the PZ Department to come back so those items -- PZ.26, PZ.27, PZ.20 and 21— under -- Commissioner Winton: What's PZ.21 ? Is that tied to PZ.26 and 27? Commissioner Regalado: No. That's different — Chairman Sanchez: No. Commissioner Winton: Oh, they're separate? Chairman Sanchez: Yes. Commissioner Allen: Mr. Chairman. Before you read any further, I kindly request you to receive these words with the same good spirit of understanding that I'm writing them. People who work with Tony and you at the City recommended us to approach you, in the certainty, they told us, that you are a nice person capable of listening and understand our reasons. First of all, I want you to know that this business doesn't belong to any big commercial chain nor any rich person or team, looking for more profits. This is the result of the effort of two families who put their savings together hoping to be able to work out their future, without harming anybody. We have nothing to do with the Barquet family other than the fact that they are the owners of the place, which we choose because we have always lived around the neighborhood and we wanted our business to be there. Precisely, we thought it was a good spot because it's a place where there has always been a bar, one way or another, and because due to its location there's no residence close enough to be disturbed. As far as the parking issue, we can assure you that this won't be a problem for the neighbors because, if you analyze it carefully, during our hours of operation there will be plenty of parking spaces along Coral Way, without having to use the parking spaces of the neighbors. On the other hand, I'm under the impression that despite the fact that you work at the City, you have been misinformed or do not know exactly the situation. We have complied with all the procedures and requirements established. There is a Zoning Board ordinance that establishes that when the Permit of Building and the Certificate of Use is granted in error, but the construction and inspections are finished, then there is no legal right to stop the CU or Final Permit. And that is our case. The purpose of this ordinance is precisely to protect people like us from loosing everything, due to an error on their part. Therefore, from the legal point of view, we are entitled to be able to open our business. Nevertheless, that is not enough for us. We wish our business to be gladly welcomed, not only by the many ones who have already expressed and signed their support, but by all the neighbors. We want to let them know that this will be a fine place where they will be able to share good times with families and friends, without having to drive far away or even not having to drive at all; that they won't be disturbed in any way; that businesses also bring prosperity to the area and the city, which is in benefit of everyone. know, by my own experience, that one of the more difficult things in life is to retract oneself and take back what we have been standing for.
