A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
GRANTING THE APPEAL FILED BY DACRA DESGIN MOORE, LLC
("APPELLANT"), AND MODIFYING A DECISION OF THE HISTORIC AND
ENVIRONMENTAL PRESERVATION BOARD ("HEPB"), WHICH DESIGNATED THE
BUENA VISTA POST OFFICE/MOORE FURNITURE BUILDING LOCATED AT
4000-4040 NORTHEAST 2 AVENUE, MIAMI, FLORIDA AS A HISTORIC DISTRICT,
BY AMENDING THE DESIGNATION REPORT TO ELIMINATE THE ATRIUM OF THE
MOORE FURNITURE BUILDING AS AN INTERIOR SPACE SUBJECT TO
REGULATION.
WHEREAS, the Miami Historic and Environmental Preservation Board, at its meeting on
September 22, 2004, Item No. 1, following an advertised hearing, adopted Resolution No. HEPB
2004-70, by a vote of six to zero (6-0), as herein set forth; and
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by
reference and incorporated as if fully set forth in this Section.
Section 2. The City Commission grants the Appeal filed by the Appellant and reverses the
decision of the Historic and Environmental Preservation Board (Resolution No. HEPB-2003-70),
which resulted in the Buena Vista Post Office/Moore Furniture Building, located at 4000-4040
Northeast 2 Avenue, Miami, Florida being designated as a historic district, by amending the
designation report to eliminate the atrium of the Moore Furniture Building as an interior space subject
to regulation. The City Commission grants this appeal.
Section 3. This Resolution shall become effective immediately upon its adoption and signature of
the Mayor.{1}
Footnotes:
{1} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar
days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall
become effective immediately upon override of the veto by the City Commission.
