HomeMy WebLinkAboutLegislation aCity of Miami Legislation Resolution City Hatt 3500 Pan American Drive Miami, FL 33133 www.ci.miami.fl.us Final Action Date: File Number: 04-01168 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), DENYING THE APPEAL FILED BY DACRA DESIGN MOORE, LLC ("APPELLANT"), AND AFFIRMING A DECISION OF THE HISTORIC AND ENVIRONMENTAL PRESERVATION BOARD ("HEPB"), WHICH DESIGNATED THE BUENA VISTA POST OFFICE/MOORE FURNITURE BUILDING LOCATED AT 4000-4040 NORTHEAST 2ND AVENUE, MIAMI, FLORIDA, AS A HISTORIC DISTRICT, INCLUDING THE ATRIUM OF HE MOORE FURNITURE BUILDING AS AN INTERIOR SPACE SUBJECT TO REGULATION. WHEREAS, the Miami Historic and Environmental Preservation Board, at its meeting on September 22, 2004, Item No. 1, following an advertised hearing, adopted Resolution No. HEPB 2004- 70, by a vote of six to zero (6-0), as herein set forth; and NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Commission denies the Appeal filed by the Appellant and affirms the decision of the Historic and Environmental Preservation Board (Resolution No. HEPB-2004-70), which resulted in the Buena Vista Post Office/Moore Furniture Building, located at 4000-4040 Northeast 2 Avenue, Miami, Florida, being designated a historic district, including the atrium of the Moore Furniture Building as an interior space subject to regulation. The City Commission further finds that the foregoing historic district does comply with the applicable criteria set forth in Chapter 23 of the Code of the City of Miami for historic district designation. The City Commission denies the instant appeal giving rise to this hearing. Section 3. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.{1} APPROVED AS TO FORM AND CORRECTNESS: JORGE L.
