1. Subject: Resolution of Protest, N.W. 14 Street Improvement Project (3rd
Bidding): From N.W. 34 Avenue to N.W. 22 Avenue (B-50686), Bid No. 03-04-
129
2. Purpose of item: It is respectfully recommended that the City Commission adopt
the attached Resolution approving the Chief Procurement Officer's decision to
uphold the protest of Williams Paving Company, Inc., rescinding the City
Manager's decision to reject all bids, and deeming Williams Paving Company,
Inc., the lowest responsive and responsible bidder.
3. History of item: The Department of Capital Improvement issued a bid for the
N.W. 14 Street Improvement Project. On August 3, 2004 at 10:00 a.m., bids were
due and received by the Office of the City Clerk. After the bids were tabulated
and evaluated, it was apparent that Williams Paving Company, Inc. was the
lowest bidder, but the bidder's responsiveness to certain aspects of the M/WBE
document submittal requirements became the focal point and the reason for the
City initially deeming Williams Paving Company, Inc. non -responsive and
rejecting all bids. However, after receiving the protest by Adorno & Yoss, P.A.,
on behalf of Williams Paving Company, this issue was reviewed by both the
Chief Procurement Officer and the Office of the City Attorney and a
determination has been made that this is a matter of responsibility and not
responsiveness. Generally, a matter of responsibility can be resolved with a
bidder before issuing an award letter, work order, notice to proceed or purchase
order.
The City of Miami, Williams Paving Company, Inc. and its' subcontractors are
diligently working together towards getting all contractors City of Miami M/WBE
certified.
It is, therefore, recommended that the City Commission adopt the attached
resolution approving the Chief Procurement Officer's decision to uphold the
protest of Williams Paving Company, inc., rescinding the City Manager's
decision to reject all bids and deeming Williams Paving Company, Inc, the lowest
responsive and responsible bidder for the N.W, 14 Street Improvement Project.
4. Does this item correlate with the CIP plan or Strategic Plan? If so, how?
The companion item recommending award to Williams Paving Company is a
funded project in the CIP plan, Project No. B-50686, project funds listed below.
5. Does this item have any effect on residents within the City of Miami? If so,
how? The companion item awarding the bid contract will improve and beautify
the affected roadways. Travel by adjacent area residents will be temporarily
disrupted during construction, but residents will be advised in advance.
6. Will this item impact any specific District? If so, which one? The companion
item awarding the bid contract will positively improve transportation in the
affected area of District 1.
7. Does this item have any fiscal impact? (please provide dollar amount)? The
companion item awarding the bid contract will be for the total amount not to
exceed $2,201,116, funds allocated from CIP No. 341183, CIP No. 331330 and
CIP No, 311711.
