HomeMy WebLinkAboutR-04-0723City of Miami Legislation Resolution: R-04-0723 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 04-01221 Final Action Date: 11/18/2004 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), ESTABLISHING A NEW SPECIAL REVENUE FUND ENTITLED: "URBAN AREA SECURITY INITIATIVE (UASI) GRANT PROGRAM III (FISCAL YEAR 2004)," CONSISTING OF A GRANT FROM THE UNITED STATES DEPARTMENT OF HOMELAND SECURITY PASSED THROUGH THE OFFICE FOR DOMESTIC PREPAREDNESS, DIRECTLY TO THE STATE OF FLORIDA DIVISION OF EMERGENCY MANAGEMENT; APPROPRIATING FUNDS FOR THE OPERATION OF SAME, IN THE AMOUNT OF $19,033,677; AUTHORIZING THE CITY MANAGER TO ACCEPT THE GRANT AWARD AND TO EXECUTE THE NECESSARY DOCUMENTS TO IMPLEMENT ACCEPTANCE OF SAID GRANT; AUTHORIZING THE EXPENDITURE OF FUNDS TO VARIOUS GOVERNMENTAL AGENCIES DESIGNATED FOR HOMELAND SECURITY EXPENSE PURSUANT TO THE UASI GRANT GUIDELINES. WHEREAS, the United States Department of Homeland Security ("DHS"), Office for Domestic Preparedness ("ODP"), Fiscal Year 2004 Urban Area Security Initiative ("UASI"), reflects the intent of Congress and the Administration to enhance and quantify the preparedness of the nation to combat terrorism; and WHEREAS, most states and municipalities have strengthened their overall capability to respond to acts of terrorism involving chemical, biological, radiological, nuclear or explosive weapons, there continues to be room for improvement in meeting our national priorities in preventing and responding to terrorist attacks; and WHEREAS, the ODP is authorized by the Emergency Wartime Supplemental Appropriations Act 2003, to provide funds to States for subsequent distribution to selected urban areas to address the unique equipment, training, planning, exercise and operational needs or large urban areas, and to assist them in building an enhanced and sustainable capacity to prevent, respond to, and recover from threats or acts of terrorism; and WHEREAS, the ODP, through the State of Florida Division of Emergency Management ("DEM"), has subgranted an UASI Grant Project III (Fiscal Year 2004) to the City of Miami ("City") and its contiguous county, Miami -Dade County ("County"), in the amount of $19,033,677, for Fiscal Year 2004; and WHEREAS, pursuant to grant stipulations, said funds will be used by the Department of Fire -Rescue to address the unique equipment, training, planning, exercise and operational needs of the City and the County and to assist the City in building an enhanced and sustainable capacity to prevent, respond to, and recover from threats or acts of terrorism; and WHEREAS, it is now appropriate for the City Manager to accept said grant and to establish a special revenue fund for the appropriation of said grant award; City of Miami Page 1 of 2 File Id: 04-01221 (Version: 1) Printed On: 10/14/2016 File Number: 04-01221 Enactment Number: R-04-0723 NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The following new Special Revenue Fund is established and resources are appropriated as described below: FUND TITLE: Urban Area Security Initiative (UASI) Grant Program (Fiscal Year 2004) RESOURCES: DHS, passed through the ODP, directly to DEM APPROPRIATIONS: $19,033,677 $19,033,677 Section 3. This appropriation is contingent upon final grant approval by DEM and the City Manager's acceptance thereof. Section 4. The City Manager is authorized{1} to accept the grant award and to execute the necessary documents to implement acceptance of said grant. Section 5. The expenditure of funds to various governmental agencies designated for Homeland Security expenses pursuant to the UASI grant guidelines is authorized. Section 6. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.{2} Footnotes: {1} The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
