COMPLAINT TO QUIET TITLE 54 GAS STATION LLC, a Florida. corporation ("Plaintiff"), sues City of Miami, a municipal corporation and political subdivision of the State of Florida ("Defendant"), and alleges as follows: PARTIES, JURISDICTION, AND VENUE 1, This is an action to quiet title in real property located in Miami -Dade County, Florida. pursuant to FLA. STAT. §65.061. 2. Plaintiff is a Florida corporation that owns real property located in :Miami -Dade County, Florida, which property is at issue in this dispute. 3. Defendant is a municipal corporation and subdivision under the laws of the State of Florida and is located in Miami -Dade County. 4. The Property (as defined below) at issue in this litigation is located within Miami - Dade County, Florida. Thus, venue is proper in Miami -Dade County, Florida pursuant to FLA. STAT. §47.051, and this Court has jurisdiction over the subject matter of this action pursuant to FLA.. STAT. §26.012(2)(g). GENERAL ALLEGATIONS 5. Since June 18, 2020, Plaintiff has owned the property located at 1.115 N.W. 54 Street, Miami, Florida 33127 (the "Property"), which is legally described as: Lot 3, Block 6, of MANOR. ESTATES, according to the map or plat thereof, recorded in Plat Book 44, Page 41, of the Public Records of Miami -Dade County, Florida. 6. Plaintiff is the owner of the Property, and deraigned title by virtue of that certain Warranty Deed dated June 18, 2020 and recorded at Book 31998, Pages 2776-2777 in the Public Records in and for Miami -.Dade County, Florida o:n. July 7, 2020, 7. On July 21, 2017, a Notice of Violation (attached hereto as Exhibit A) was issued to the previous own.er for "fail ure to maintain exterior of commercial or residential property" in violation of City Code Chapter 10, Sections 10-23 and 10-24. 8. :Based on. emails obtained, the previous owner moved swiftly to correct the violation, communi.cati.ng with the code enforcement officer regarding compliance August 2017 and again February 2018. However, the previous owner failed to obtain an Affidavit of Compliance from the City. 9. At a Code Enforcement Board Hearing on December 7, 201.7, the Code • Enforcement Board of the City of Miami found that Plaintiff violated the City Code by: failing to maintain exterior of commercial. or residential property in violation of City Code Chapter 1.0, Sections 10-23 and 10-24. 10. The Board issued an Order which imposed a daily fine of $250.00 pe:r day and on March 14, 2018, the Final Administrative Enforcement Order was recorded. A true and correct copy of the Order is attached as Exhibit B. 1.1. Plaintiff acquired the property in June 2020 and remained unaware of the violations or the Order until October 2023, when a title search was ordered on the property which revealed the pending lien. 12. Plaintiff then contacted the City and requested the Property be inspected for compliance. Acknowledging that all violations had been cured, the City issued an Affidavit of Compliance (attached hereto as Exhibit C) on January 3, 2024, confirming compliance as of December 27, 2023. 13, Section 2-817(d)(2) of Defendant's Code provides that mitigation is not available for properties that exceed 271 days to reach compliance except for the exceptions listed in subsection (d)(4) of Defendant's Code. Plaintiff does not qualify under any of the exceptions. Accordingly, mitigation is not available to Plaintiff. 14. A lien in the amount of $552,500.00 exists on the Property. 15. Before filing this cause of action, Plaintiff communicated with Defendant in an. attempt to mitigate the fines to no avail. 16. All conditions precedent have been completed before the filing of this cause of action. COUNT I — QUIET TITLE ,the Property) 17. This is an action to quiet title pursuant to FLA. STAT. §§65.021. and 65.061. 18. Plaintiff incorporates and realleges the allegations in paragraphs 1 through 16 are incorporated as if set forth fully herein. 19. The Order imposed a lien on the Property. 20. Defendant may claim an adverse interest in the Property by virtue of the aforementioned lien. 3 21. Defendant does not have a lawful or legitimate interest in the Property, and any interest in the Property, if any, is subordinate and inferior to the Plaintiff's right, title, and interest in the Property. 22. Plaintiff is authorized to bring an action to quiet title to the Property and to clear any cloud on its title. See Section 65.031, Florida Statutes ("An action in chancery for quieting title to, or clearing a cloud from, land may be maintained in the name of the owner or of any prior owner who warranted the title.") 23. Plaintiff has a compelling interest in removing the cloud of title imposed by the Order and the lien because the the title of the Property is currently unmarketable. 'WHEREFORE, the Plaintiff respectfully requests that this Court enter a judgment in its favor and against Defendant extinguishing any right or claim. that Defendant may have in the Property, and removing any and all clouds on title to the Property, and quieting title in the Plaintiff, together with any and such further relief as this Court deems necessary to protect Plaintiff's rights and interests to the Property.
