AN ORDINANCE OF THE MIAMI CITY COMMISSION AMENDING ORDINANCE
NO. 11000, AS AMENDED, THE ZONING ORDINANCE OF THE CITY OF MIAMI,
FLORIDA, BY AMENDING ARTICLE 9, SECTION
917, TO PROVIDE FOR A NEW SECTION 917.15, "SPECIAL PARKING
REQUIREMENTS FOR HISTORIC PROPERTIES;" CONTAINING A REPEALER
PROVISION AND A SEVERABLITY CLAUSE; AND PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, the Miami Planning Advisory Board, at its meeting held on July 21, 2004 Item No. 1,
following an advertised public hearing, adopted Resolution No. PAB 96-04 by a vote of seven to zero
7-0), RECOMMENDING APPROVAL to amend Ordinance 10544;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORI DA:
Section 1. Section 917 of Ordinance No. 11000, as amended, the Zoning Ordinance of the City of
Miami, Florida, is hereby amended as follows:
"ARTICLE 9. GENERAL AND SUPPLEMENTARY REGULATIONS
Sec. 917. Offstreet parking requirements, general provisions.
Sec. 917.15. Special parking requirements for historic properties.
Notwithstanding any provision of this zoning ordinance, as amended, the requirements for offstreet
parking location and size may be modified by the Historic and Environmental Preservation Board
pursuant to a Certificate of Appropriateness. In all other respects, the proposal shall comply with the
applicable requirements of the building code.
917.15.1. Applicability. This section shall apply only to those historic sites and/or historic districts that
have been designated pursuant to Chapter 23 of the Miami City Code.
917.15.2. Procedure. Applications for modifications to the requirements for offstreet parking location
and/or size shall be made pursuant to the provisions for Certificates of Appropriateness as set forth in
Section 23-5 of the Miami City Code.
917.15.3. Criteria. In addition to guidelines for issuing Certificates of Appropriateness as set forth in
Section 23-5(c) of the Miami City Code the following criteria shall also apply:

(a) Granting the modification would further the preservation of the historic and architectural
character of the historic site or historic district in which the proposal is located.
ILI Granting the modification would promote the preservation of the historic site or historic
district while reducing nonconformities.
} Granting the modification would help to minimize or mitigate any potential adverse effect of
a specific proposal whose implementation promotes the preservation of the historic site
or historic district.
917.15.4. Specific findings required. The Historic and Environmental Preservation Board shall make
specific findings that establish how the above criteria have been met. Additionally, the Board may
impose any conditions, restrictions or limitations deemed appropriate in order to ensure compliance
with the criteria set forth above, as well as those in Section 1305 of this ordinance.

Section 2. All ordinances or parts of ordinances insofar as they are inconsistent or in conflict
with the provisions of this Ordinance are hereby repealed.
Section 3. If any section, part of section, paragraph, clause, phrase or word of this Ordinance
is declared invalid, the remaining provisions of this Ordinance shall not be affected.
Section 4. This Ordinance shall become effective thirty (30) days after final reading and
adoption thereof. {1}

days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become
effective immediately upon override of the veto by the City Commission.
