Pursuant to Section 401 of Ordinance 11000, as amended, the Zoning Ordinance of the
City of Miami, Florida, the subject proposal to allow a community based residential
facility with thirty-three (33) clients in the C-1 Restricted Commercial District has been
reviewed as follows:
NOTE: The Special Exception for the Community Based Residential Facility
requires City Commission approval.
Per Section 934.2.2.5., this Special Exception also encompasses a reduction of
seven (7) of the required off-street parking spaces (therefore resulting in
eleven (11) spaces where eighteen (18) are required).
The following findings have been made:
• It is found that the proposed application is for change of ownership of an existing
community based residential facility. It is also found that the use has being providing
a needed service to the community and has maintained employment opportunities.
• It is found that the existing use is an adaptive re -use of the existing structure and it is
also found that the use is in scale and character with the surrounding area.
• It is found that as presented, the requested amount of clients (33) is appropriate,
especially since it is just a change of ownership, for this facility. No additional
numbers of clients are being requested as part of the request to change owners.
• It is found that the requested reduction in parking spaces is not unreasonable since the
facility is located immediately adjacent to public transit stop. In addition, the facility
has been in operation with the same number of parking since 1992.
• It is found that with respect to all additional criteria as specified in Section 1305 of
Zoning Ordinance 11000, the proposal has been reviewed and found to be adequate.
Based on these findings, the Planning and Zoning Department is recommending
approval of the proposed facility as presented.
