HomeMy WebLinkAboutR-04-0706City of Miami Legislation Resolution: R-04-0706 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 04-01151 Final Action Date: 10/28/2004 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AUTHORIZING THE TRANSFER OF COMMUNITY DEVELOPMENT BLOCK GRANT PROGRAM FUNDS, IN THE TOTAL AMOUNT OF $2,965,179, FROM THE CITY OF MIAMI COMMUNITY REDEVELOPMENT AGENCY ("CRA") RESERVE ACCOUNT; ALLOCATING SAID FUNDS, IN THE AMOUNT OF $776,210, TO THE CITY OF MIAMI CRA'S GRAND PROMENADE PROJECT, AND THE AMOUNT OF $2,188,969 TO THE DISTRICT 5 SINGLE FAMILY REHABILITATION PROGRAM; AUTHORIZING THE CITY MANAGER TO EXECUTE AN AGREEMENT, IN SUBSTANTIALLY THE ATTACHED FORM, WITH THE CRA FOR SAID PURPOSE. WHEREAS, Resolution No. 02-495, adopted April 25, 2002, re -categorized previously approved Community Development Block Grant ("CDBG") Program funds from the economic development category to the public improvements category, in an amount not to exceed $5,000,000 pursuant to Resolution Nos. 00-427 and 01-1150 for the historic Overtown priority business corridor and the Overtown/Park West district; and WHEREAS, on May 19, 2003, the Community Redevelopment Agency ("CRA") board approved the creation and the funding for the Grand Promenade Project ("Project"); and WHEREAS, this administration is requesting that CDBG funds in the total amount of $2,965,179, be transferred from City of Miami ("City") CRA Reserve Account; and WHEREAS, said funds in an amount not to exceed $2,965,179, have not been utilized, and said recovered funds are recommended to be transferred to the CRA's Project in the amount of $776,210, and to the District 5 Single Family Rehabilitation Program in the amount of $2,188,969; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The transfer of CDBG Program funds, in the total amount of $2,965,179, from the City's CRA Reserve Account and the allocation of said funds, in the amount of $776,210, to the CRA's Project, and the amount of $2,188,969, to the District 5 Single Family Rehabilitation Program, is authorized. Section 3. The City Manager is authorized{1} to execute an Agreement, in substantially the attached form, with the CRA for said purpose. This Resolution shall become effective immediately upon its adoption and signature of the Mayor {2}. Footnotes: {1} The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
