HomeMy WebLinkAboutR-04-0701City of Miami Legislation Resolution: R-04-0701 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 04-01088 Final Action Date: 10/28/2004 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AUTHORIZING THE CITY MANAGER TO EXECUTE A PROFESSIONAL SERVICES AGREEMENT, IN SUBSTANTIALLY THE ATTACHED FORM, WITH FLORIDA INTERNATIONAL UNIVERSITY TO PROVIDE TECHNICAL SUPPORT TO LEADERSHIP GROUPS IN THE COMMUNITY OF OVERTOWN FOR TRANSPORTATION -RELATED PROJECTS, THROUGH JUNE 31, 2006, IN AN AMOUNT NOT TO EXCEED $57,000; ALLOCATING FUNDS FROM THE NEW SPECIAL REVENUE FUND ENTITLED: "OVERTOWN TECHNICAL SUPPORT FUND," APPROVED BY RESOLUTION NO. 04-0565, ADOPTED SEPTEMBER 9, 2004, CONSISTING OF A GRANT FROM THE FLORIDA DEPARTMENT OF TRANSPORTATION. WHEREAS, on September 9, 2004, the City Commission approved Resolution No. 04-0565 to appropriate grant funds from the Florida Department of Transportation ("FDOT"), through a Joint Participation Agreement, into a new special revenue fund, entitled: "Overtown Technical Support Fund," in the amount of $60,000; and WHEREAS, said funds shall provide for independent technical support, related to transportation projects, to leadership groups in the community of Overtown through a Professional Services Agreement ("Agreement") with Florida International University ("FIU"); and WHEREAS, pursuant to Section 18-112 of the City of Miami ("City") Procurement Ordinance, State funded institutions are exempt from all competitive bidding procedures when they enter into an Agreement with other governmental agencies for the acquisition of services; and WHEREAS, the term of the agreement with FIU shall commence on the effective date and continue until June 31, 2006; and WHEREAS, it will be necessary for the City Manager to execute an Agreement with FIU for this purpose; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if set forth in this Section. Section 2. The City Manager is authorized{1} to execute an Agreement, in substantially the attached form, with FIU to provide technical support to leadership groups in the community of Overtown for transportation -related projects, through June 31, 2006, in an amount not to exceed $57,000, with funds allocated from the new special revenue fund entitled: "Overtown Technical Support Fund," approved by Resolution No. 04-0565, adopted September 9, 2004, consisting of a City of Miami Page 1 of 2 File Id: 04-01088 (Version: 1) Printed On: 10/13/2016 File Number: 04-01088 Enactment Number: R-04-0701 grant from FDOT. Section 3. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.{2} Footnotes: {1} The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} This Resolution shall become effective as specified herein unless vetoed by the Mayor within ten days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission or upon the effective date stated herein, whichever is later.
