HomeMy WebLinkAboutR-04-0688City of Miami Legislation Resolution: R-04-0688 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 04-01134 Final Action Date: 10/28/2004 A RESOLUTION OF THE MIAMI CITY COMMISSION RECOGNIZING THE MIAMI-DADE COUNTY FEDERAL EMERGENCY MANAGEMENT AGENCY ROAD RESTORATION AND DRAINAGE REPLACEMENT PROJECT, CONTRACT NO. C01-DERM-EEC, LOCATED ON NORTHWEST 62ND STREET BETWEEN NORTHWEST 2ND AVENUE AND NORTHWEST 7TH AVENUE, MIAMI, FLORIDA, AS A JOINT PROJECT BETWEEN THE CITY OF MIAMI AND MIAMI-DADE COUNTY; DIRECTING THE CITY MANAGER, PURSUANT TO SECTION 54-17 OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED ("CITY CODE"), TO WAIVE ALL CITY OF MIAMI PUBLIC WORKS EXCAVATION FEES, IN AN AMOUNT OF $28,000, ASSESSED PURSUANT TO SECTION 54-43 OF THE CITY CODE. WHEREAS, the Miami -Dade County ("County") Department of Environmental Resources Management has completed construction plans for the Federal Emergency Management Agency ("FEMA") Road Restoration and Drainage Replacement Project, Contract No. CO1-DERM-EEC, located on Northwest 62nd Street between Northwest 2nd Avenue and Northwest 7th Avenue, Miami Florida; and WHEREAS, these road restoration and drainage projects were approved by FEMA, as a result of the flooding associated with Hurricane Irene and with other storms, to repair infrastructure damage and implement hazard mitigation projects to reduce flooding and related property damage in the future; and WHEREAS, this portion of Northwest 62nd Street is within the City of Miami ("City") boundary limits and is County maintained, but the implementation of this new drainage system would alleviate flooding conditions for the citizens that live in the area and would improve traffic conditions along the road during the rainy season; and WHEREAS, specifically, this project will add a new drainage system to mitigate flooding in this important corridor and consists in the installation of a 33 drainage structures and 3,300 lineal feet of drainage pipe for an estimated cost of $880,074; and WHEREAS, said project, with an estimated total cost of $880,074, is funded by FEMA who is paying for 75% of the cost along with the State and County are evenly dividing the remaining 25% of total costs; and WHEREAS, the City has not been asked to contribute funds towards the projects but has been asked to waive public excavation permit fees, in the amount of $28,000, assessed pursuant to Section 54-43, of the Code of the City of Miami, Florida, as amended ("City Code"), so that this project may be implemented and benefit the health safety and welfare of the City and the County; and WHEREAS, the stormwater drainage improvements scheduled to be completed in the project City of Miami Page 1 of 2 File Id: 04-01134 (Version: 1) Printed On: 10/13/2016 File Number: 04-01134 Enactment Number: R-04-0688 will directly benefit the City, its residents and the general public at large; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The Miami City Commission recognizes the County's FEMA Road Restoration and Drainage Replacement Project, Contract No. CO1-DERM-EEC, located on Northwest 62nd Street between Northwest 2nd Avenue and Northwest 7th Avenue, Miami, Florida, as a joint project between the City and the County. Section 3. The City Manager is directed, pursuant to Section 54-17, of the City Code, to waive City public works excavation fees in the amount of $28,000, assessed pursuant to Section 54-43 of the City Code. Section 4. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.{1} Footnotes: {1} If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
