Renewal of Submerged Land
Lease adjacent to Ft. Dallas
Park
RECOMMENDATION:
It is respectfully requested that the City Commission adopt the attached Resolution
authorizing the City Manager to execute a Submerged Land Lease Renewal, in substantially
the attached form, between the City of Miami (the "City") and the Board of Trustees of the
Internal Improvement Trust Fund of the State of Florida, to provide for a term of five (5)
years for the City's continued use of submerged land owned by the State of Florida adjacent
to the upland property owned by the City located at 60 S.E 4th Street, Miami, Florida, c/k/a
Fort Dallas Park (the "Park"). This resolution further authorizes the City Manager to execute
future renewals to the term of the submerged land lease as approved by the State of Florida,
said lease to be with no rent so long as the slips are used for temporary dockage.
BACKGROUND:
The City executed a Sovereignty Submerged Land Lease with the Board of Trustees of the
Internal Improvement Trust Fund of the State of Florida, for an initial term of five (5) years,
which term was extended for an additional period of five (5) years that expired on July 26,
2004. Said Submerged Land Lease authorized the City's use of submerged land owned by
the State of Florida adjacent to the City -owned property located at 60 S.E. 4th Street,
commonly known as Fort Dallas Park. The upland property is currently being used by
Miama River Group, Inc. d/b/a Bijan's, under a restaurant agreement with the City of
Miami. The Submerged Land Lease provides for the operation of a marginal dock in
connection with the Park and restaurant at said location.
The Submerged Land Lease can be extended at the sole option of the State. The State
waived its fees for the use of this submerged land so long as it serves public interest and the
slips are used for temporary dockage.
Financial Impact: There is no impact to the general fund of the City since there are
no fees associated with the execution of the submerged land lease agreement.
However, in the event the City changes the use of the docks from temporary to rental
of wet slips, it will require State approval and a fee to the State will be applicable
subject to the Florida Administrative Code 18-21.011 (1)(b).
