A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
AUTHORIZING THE CITY MANAGER TO CONVEY TO THE STATE OF FLORIDA,
DEPARTMENT OF TRANSPORTATION ("FDOT"), A STRIP OF LAND CONTAINING
APPROXIMATELY 5,737 SQUARE FEET, LYING ADJACENT TO BISCAYNE
BOULEVARD, BETWEEN NORTHEAST 8TH STREET AND NORTHEAST 9TH
STREET, MIAMI, FLORIDA ("PROPERTY"), REFERRED TO AS PARCEL 101, AS
MORE PARTICULARLY DESCRIBED IN "EXHIBIT A," ATTACHED AND
INCORPORATED, WITH FDOT REQUESTING FEE SIMPLE OWNERSHIP OF THE
PROPERTY TO MAKE IMPROVEMENTS TO THE SIDEWALK FOR THE PURPOSE
OF TYING IN THE SIDEWALK IMPROVEMENTS TO THE OVERALL PROJECT
KNOWN AS THE BURLE MARX PROJECT; FURTHER AUTHORIZING THE CITY
MANAGER TO EXECUTE A DEED, IN SUBSTANTIALLY THE FORM ATTACHED AS
"EXHIBIT B," AND ALL OTHER NECESSARY DOCUMENTS, IN A FORM
ACCEPTABLE TO THE CITY ATTORNEY, TO EFFECTUATE SAID CONVEYANCE.
WHEREAS, the State of Florida Department of Transportation ("FDOT") is in the process of
constructing and improving State Road No. 5 (Biscayne Boulevard), Item/Segment No. 2498352, in
Miami -Dade County, Florida; and
WHEREAS, the City of Miami, ("City") is the owner of a strip of land 18 feet wide by 318.68 feet
long, lying adjacent to Biscayne Boulevard between Northeast 8th Street and Northeast 9th Street,
Miami, Florida ("Property"), hereinafter referred to as Parcel 101, as more particular described in
"Exhibit A," attached and incorporated; and
WHEREAS, FDOT has requested fee simple ownership of this Property to make improvements to
the sidewalk for the purpose of tying in the sidewalk improvements to the overall project known as the
Burle Marx Project; and
WHEREAS, it is necessary that the strip of land now owned by the City and not needed for City
purposes, be provided to FDOT to complete the improvements as requested by the City, to serve the
best interest of the general welfare of the City and its inhabitants;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by
reference and incorporated as if fully set forth in this Section.
Section 2. The City Manager is authorized{1} to convey to FDOT, the Property, as described in
"Exhibit A, " attached and incorporated, and FDOT has requested fee simple ownership of said
Property to make improvements to the sidewalk for the purpose of tying in the sidewalk improvements
to the overall project known as Burle Marx Project.

Section 3. The City Manager is authorized{1} to execute a Deed, in substantially the form
attached as "Exhibit B," and all other necessary documents, in a form acceptable to the City Attorney,
to effectuate said conveyance.
Section 4. This Resolution shall become effective immediately upon its adoption and signature of
the Mayor. {2}
Footnotes:
{1} The herein authorization is further subject to compliance with all requirements that may be
imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter
and Code provisions.
{2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten days from
the date it was passed and adopted. If the Mayor vetoes this Resolution it shall become effective
immediately upon override of the veto by the City Commission.
