RECOMMENDATION:
It is respectfully recommended that the City Commission adopt the attached Resolution
authorizing the City Manager to convey to the State of Florida, Department of Transportation
("FDOT"), a strip of land containing approximately 5,737 square feet, lying adjacent to Biscayne
Boulevard, between Northeast 8th Street and Northeast 9th Street, Miami, Florida (Property"),
hereinafter referred to as Parcel 101, as more particularly described in Exhibit "A" attached and
incorporated. FDOT has requested fee simple ownership of this Property to make
improvements to the sidewalk for the purpose of tying in the sidewalk improvements to the
overall project known as the Burle Marx Project. This Resolution further authorizes the City
Manager to execute all documents which are necessary to effectuate said conveyance.
BACKGROUND:
The State of Florida Department of Transportation ("FDOT") is in the process of constructing or
improving State Road No. 5 (Biscayne Boulevard), Item/Segment No. 2498352, in Miami -Dade
County, Florida. The City of Miami is the owner of a strip of land 18 feet wide by 318.68 feet
long, lying adjacent to Biscayne Boulevard between Northeast 8th Street and Northeast 9th
Street, Miami, Florida ("Property"), hereinafter referred to as Parcel 101, as more particular
described in "Exhibit A", attached and incorporated. FDOT has requested ownership in fee
simple of this property in order to make improvements to the sidewalk for the purpose of tying
in the sidewalk improvements to the overall project known as the Burle Marx Project.
It is necessary that this strip of land now owned by the City of Miami and not needed for City
purposes, be provided to FDOT to complete the improvements requested by the City in order
to serve the best interest of the general welfare of the City of Miami and its inhabitants.
Financial Impact: � There is no negative financial impact to the City.
