HomeMy WebLinkAboutR-04-0669City of Miami Legislation Resolution: R-04-0669 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 04-01091 Final Action Date: 10/14/2004 A RESOLUTION OF THE MIAMI CITY COMMISSION BYA FOUR -FIFTHS (4/STHS) AFFIRMATIVE VOTE, AFTER AN ADVERTISED PUBLIC HEARING, RATIFYING, APPROVING AND CONFIRMING THE CITY MANAGER'S FINDING OF A SOLE SOURCE; WAIVING THE REQUIREMENTS FOR COMPETITIVE SEALED BIDDING PROCEDURES AND APPROVING THE ACQUISITION OF THREE (3) 8028 UNIVERSAL PORTACOUNT FIT TEST SYSTEMS WITH ACCESSORIES, WHICH CONTAINS BOTH MODELS 8020 PORTACOUNT PLUS AND 8095 N-95 COMPANION, INCLUDING TRAINING AND MAINTENANCE SUPPORT SERVICES FROM TSI INCORPORATED C/O DAWSON ASSOCIATES, INC., THE DESIGNATED SOLE SOURCE REPRESENTATIVE FOR TSI INCORPORATED, IN THE SOUTHEASTERN REGION OF THE UNITED STATES FOR THE DEPARTMENT OF FIRE -RESCUE, FOR A TOTAL CONTRACT AMOUNT NOT TO EXCEED $33,000; ALLOCATING FUNDS FROM THE FEDERAL GRANT ENTITLED, "URBAN AREAS SECURITY INITIATIVE GRANT PROGRAM II," PROJECT NO. 110111, ACCOUNT CODE NO. 280910.6.840. WHEREAS, the proposed 8028 Universal PortaCount Fit Test System with accessories will ensure the safety of the City of Miami's first responders from debris, smoke, airborne chemicals, and other possible Weapons of Mass Destruction by evaluating the firefighter's direct fit from his/her face to the actual mask and respirator; and WHEREAS, the automated process measures and compares the concentration of particles around the firefighter's head with the concentration of those particles that leak into the firefighter's respirator; and WHEREAS, this respirator equipment will meet the United States Department of Labor Occupational Safety & Health Administration's compliance that now requires all respirator face pieces to be fit and tested annually; and WHEREAS, the Chief Procurement Officer has adopted a finding that TSI Incorporated c/o Dawson Associates, Inc., is the sole source representative of TSI Incorporated, to provide the 8028 PortaCount Fit Test System with accessories, including training and maintenance support services; and WHEREAS, the finding of the Chief Procurement Officer has been approved and adopted as the finding of the City Manager; and WHEREAS, the City Manager and the Chief of the Department of Fire -Rescue ("Fire -Rescue") recommend that the requirements for formal competitive sealed bidding procedures be waived and the procurement of the above service as specified be approved; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, City of Miami Page 1 of 2 File Id: 04-01091 (Version: 1) Printed On: 10/12/2016 File Number: 04-01091 Enactment Number: R-04-0669 FLORIDA; Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. By a four -fifths (4/5ths) affirmative vote after an advertised public hearing, the City Manager's finding of sole source, waiving the requirements for competitive sealed bidding procedures, is ratified, approved and confirmed, and the acquisition of three (3) 8028 Universal PortaCount Fit Test Systems with accessories, which contains both models 8020 PortaCount Plus and 8095 N-95 Companion, including training and maintenance support services from TSI Incorporated c/o Dawson Associates, Inc., the sole designated sole source representative of TSI Incorporated, in the Southeastern region of the United States for Fire -Rescue, is approved, for a total contract amount not to exceed $33,000, with funds allocated from the Federal grant entitled, "Urban Areas Security Initiative Grant Program II," Project No. 110111, Account Code No. 280910.6.840. Section 3. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.{1} Footnotes: {1} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
