HomeMy WebLinkAboutAnalysisANALYSIS FOR ZONING CHANGE Approximately 2957, 2981 & 2983 SW 38th COURT CASE NO: 2004-0818 Pursuant to Article 4, Section 401 of Ordinance 11000, as amended, the Zoning Ordinance of the City of Miami, Florida, the subject proposal has been reviewed for an amendment to the Zoning Atlas as follows: The request is to change the Zoning designation from R-2 "Two -Family Residential" to R-2 "Two -Family Residential" with an SD-12 Buffer Overlay District as follows: The subject properties consist on two parcels fronting SW 38th Court between SW 29th Street and SW 40th Street more specifically described on file with the Hearing Board Office. The following findings have been made: • It is found that immediately adjacent to the south, the area is designated C-2 "Liberal Commercial". • It is found that this application is in order to bring a parking use on two lots facing SW 38th Court immediately north of the existing alley that serves the C-2 "Liberal Commercial uses immediately to the south. • It is found that the requested change will be beneficial to the immediately adjacent area to the south in that it will provide surface parking for commercial uses along SW 40th Street which would otherwise park within the neighborhood, and it will provide new landscaping to the proposed parking area which will beautify and buffer the parking use. • It is found that the requested zoning designation change is consistent with the underlying land use designation and therefore does not require an amendment to the Future Land Use Map of the Comprehensive Plan. Based on these findings, the Planning and Zoning Department is recommending approval of the application as presented. ANALYSIS FOR ZONING CHANGE Yes No N/A CASE NO. 2004-0818 In harmony with Comp.
