CASE NO. 2004-0829
Pursuant to Article 4, Section 401 of Ordinance 11000, as amended, The Zoning
Ordinance of the City of Miami, Florida, the subject proposal has been reviewed to allow
a child day care in excess of twenty (20) children, in this case, for sixty (40) children, to
be placed in PR ""Parks and Recreation" as follows:
The following findings have been made:
• It is found that the use is existing and will still be beneficial to the area by providing a
continued service to the adjacent residential area as well as maintaining employment
opportunities.
• It is found that the proposed child daycare use is appropriate for an existing PR "Parks
and Recreation" zoning designation. In addition, the proposed new structure will be
replacing an old existing daycare structure that needs to be updated; this new structure
can accommodate the requested forty (40) children and comply, at the same time,
with all the latest codes requirements.
• It is found that the proposed layout provides adequate circulation. However, a Special
Exception, as a companion item in this agenda, is deferring some of the required
parking because the location where the parking will be provided, it is now temporally
being use by a temporary Fire Station until a new one is built.
• It is found that the proposed facade is adequate from the design point of view;
however, signs and paint color samples have not been provided to determine aesthetic
impact.
• It is found that there is not a landscape plan included as part of this petition.
• It is found that with respect to all additional criteria as specified in Section 1305 of
Zoning Ordinance 11000, the proposal has been reviewed and found to be adequate.
• It is found that upon compliance with condition set forth below, this project will not
have any adverse impacts on the surrounding area.
Based on these findings, the Planning and Zoning Department is recommending
approval of the application with the following condition:
1. Paint color samples and signs specifications should be submitted to the Planning
and Zoning Department for review and approval prior to issuance of any
building permit.
