It la respectfully recommended that the City Commission adopt th• attaohed Resolution finding that
acquisition of private property through negotiated conveyance or eminent domain serves a public, purpose
and Is necessary for oreatlon of park land and oonstruation of publicfacilities in The Little Haiti
community. The Resolution further authorizes the City Attorney's Wive to initiate eminent domain
proceedings and authorizes the Mt? Attom.y'e and City Manager's Office to Mein expert witneasea and
consultants and rake further salons that ere numbly required to acquire the property described In
Exhibit "A" and providing for an effective date.

The City Commission desires to prersrvs the cultural makeup and enhance the residential ohmmeter of the
Little Haiti community, !pelted in the north central seetion of the City of Miami, by creating additional
park land and constructing pub}lc, Mollifier to serve the oommun#ty. It established • working group,
conducted public meetings and workshops, and reviewed recommendstlons from oititene regarding the
Little Haiti community's need for additional park land and public facilities. The City Commleelon has
considered the recreational end cultural needs of' residents In the Little Haiti community and hes
evacuated the expected benefits of additional park lend and public facilities to the community. It has
reviewed s park land aasosament study and en open space evaluM an report for the Little Haiti
community and hos determined that the com nurtity's w sting park land 1e deficient in acreage and
recreational and uultursl activities. It Incited suitable areas to create park !and artd construct public
facilities, acquired and assembled numerous contiguous parcels, and approved contracts with latd
planners, architects, and ether profbssronais to plan and design propelled Improvement(' for recreational
and cultural activities.
The City Commission has identified privately owned property, described in Exhibit "A" attached hereto
that is immediately adjacent to other City owned property upon which the City plena to create park land
and construct publie facilities. It finds that acgttiaition of fee elmple Oils to the property described herein

serve the recreational and cultural needs of the Little Haiti community. it has considered costr, long.

that it is necessary to take legal notion and employ legal counsel, real estate appraisers, end other exports
to eacomplislt such acquisition.
On ;line 24, 2004 the City Commission adopted Resolution No. 04-0390 authorizing the retention of
epeotal counsel to render legal services in an amount not to exceed Two Hundred mousnnd Dollars
($200,000.00). The City Comrnlse1on is authorized by Sections 166.401 and 166.411, Florida Statutes, to
