HomeMy WebLinkAboutR-04-0618City of Miami Legislation Resolution: R-04-0618 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 04-01024 Final Action Date: 9/23/2004 A RESOLUTION OF THE MIAMI CITY COMMISSION ACCEPTING THE CITY MANAGER'S RECOMMENDATION APPROVING THE FIRST FINDING OF THE EVALUATION COMMITTEE TO ACCEPT THE PROPOSAL OF MERCY MEDICAL DEVELOPMENT D/B/A MERCY OUTPATIENT CENTER ("MERCY') TO PERFORM THE FOLLOWING EMPLOYMENT DRUG SCREENING SERVICES FOR PART I: (A) COLLECTION FACILITY, (B) DRUG TESTING FACILITY, AND (C) MRO SERVICES AND THE FOLLOWING PART II SWORN FIRE DRUG SCREENING SERVICES: (A) COLLECTION FACILITY, (B) DRUG TESTING FACILITY, AND (C) MRO SERVICES, FOR DESIGNATED PERSONNEL, FOR THE DEPARTMENT OF EMPLOYEE RELATIONS ("EMPLOYEE RELATIONS"); AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE A PROFESSIONAL SERVICES AGREEMENT ("AGREEMENT") WITH MERCY, IN SUBSTANTIALLY THE ATTACHED FORM, FORATWO-YEAR PERIOD, WITH THE OPTION TO RENEW FOR TWO ADDITIONAL ONE-YEAR PERIODS, AT AN ESTIMATED ANNUAL COST NOT TO EXCEED $30,000, WITH A COST INCREASE NOT TO EXCEED TEN PERCENT (10%) EFFECTIVE ONLY DURING THE FIRST ONE-YEAR OPTIONAL PERIOD OF THE CONTRACT WITH NO COST INCREASES FOR THE SECOND OPTIONAL PERIOD, FOR AN ESTIMATED TOTAL CONTRACT AMOUNT NOT TO EXCEED $123,000; FURTHER ACCEPTING THE RECOMMENDATION OF THE CITY MANAGER TO APPROVE THE SECOND FINDING OF THE EVALUATION COMMITTEE TO ACCEPT THE PROPOSAL OF PREVENTIVE MEDICINE TESTING CENTERS INC. D/B/A GLOBAL MRO ("GLOBAL") SERVICES FOR PART III, DOT ALCOHOL AND CONTROLLED SUBSTANCES TESTING: (A) COLLECTION FACILITY, (B) DRUG TESTING FACILITY, AND (C) MRO SERVICES AND PART IV, SWORN POLICE DRUG SCREENING SERVICES: (A) COLLECTION FACILITY, (B) DRUG TESTING FACILITY AND (C) MRO SERVICES, FOR DESIGNATED PERSONNEL, FOR EMPLOYEE RELATIONS, AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE AN AGREEMENT WITH GLOBAL, IN SUBSTANTIALLY THE ATTACHED FORM, FORA TWO-YEAR PERIOD, WITH THE OPTION TO RENEW FOR TWO ADDITIONAL ONE-YEAR PERIODS, AT AN ESTIMATED ANNUAL COST NOT TO EXCEED $67,375, WITH A COST INCREASE NOT TO EXCEED TEN PERCENT (10%) EFFECTIVE ONLY DURING THE FIRST ONE-YEAR OPTIONAL PERIOD OF THE CONTRACT WITH NO COST INCREASES FOR THE SECOND OPTIONAL PERIOD, FOR AN ESTIMATED TOTAL CONTRACT AMOUNT NOT TO EXCEED $276,237.50; ALLOCATING FUNDS, FROM THE GENERAL OPERATING BUDGETS OF THE DEPARTMENT OF EMPLOYEE RELATIONS, ACCOUNT CODE NO. 001000.270101.6.260, DEPARTMENT OF FIRE -RESCUE, ACCOUNT CODE NO. 001000.280401.6.260, AND THE DEPARTMENT OF POLICE, ACCOUNT CODE NO. 001000.290201.6.260. City of Miami Page 1 of 3 File Id: 04-01024 (Version: 1) Printed On: 9/30/2016 File Number: 04-01024 Enactment Number: R-04-0618 WHEREAS, pursuant to public notice, Request for Proposal ("RFP") No. 03-04-059 was issued to perform drug screening services for designated personnel, on a contract basis for two years, with the option to renew for two additional one-year periods, for the Department of Employee Relations ("Employee Relations"); and WHEREAS, the RFP for drug screening services was divided into the following four (4) parts: Part I: Employment Drug Screening Services, Part II: Sworn Fire Drug Screening Services, Part III: Dot Alcohol and Controlled Substances Testing, and Part IV: Sworn Police Drug Screening Services; and WHEREAS, RFPs were received on April 12, 2004, and the proposals were evaluated by an Evaluation Committee appointed by the City Manager which recommended that the proposals received from Mercy Medical Development, d/b/a Mercy Outpatient Center, ("Mercy') for Drug Screening Services Part I: Employment Drug Screening Services, ((A) Collection Facility, (B) Drug Testing Facility, and (C) MRO Services), and Part II: Sworn Fire Drug Screening Services ((A) Collection Facility, (B) Drug Testing Facility, and (C) MRO Services), and from Preventive Medicine Testing Centers Inc. d/b/a Global MRO ("Global'), for Drug Screening Services Part III: DOT Alcohol and Controlled Substances Testing ((A) Collection Facility, (B) Drug Testing Facility, and (C) MRO Services), and Part IV: Sworn Police Drug Screening Services ((A) Collection Facility, (B) Drug Testing Facility, and (C) MRO Services), be accepted as the proposal most advantageous to the City; and WHEREAS, the City Manager and the Director of Employee Relations concur with the recommendation that the proposals received from Mercy, for Part I: Employment Drug Screening Services, and Part II: Sworn Fire Drug Screening Services, and from Global, for Part III: DOT Alcohol and Controlled Substances Testing, and Part IV: Sworn Police Drug Screening Services, be accepted as the proposals most advantageous to the City; and WHEREAS, funds for Part I: Employment Drug Screening Services, and Part II: Sworn Fire Drug Screening Services, at an estimated annual cost not to exceed $30,000, with a cost increase not to exceed ten percent (10%) effective only during the first one-year renewable period of the contract with no cost increases for the second renewable period, for an estimated total contract amount not to exceed $123,000, and funds for Part III: DOT Alcohol and Controlled Substances Testing, and Part IV: Sworn Police Drug Screening Services, at an estimated annual cost not to exceed $67,375, with a cost increase not to exceed ten percent (10%) effective only during the first one year renewable period of the contract with no cost increases for the second renewable period, for an estimated total contract amount not to exceed $276,237.50 are available from the General Operating Budgets for the Department of Employee Relations, Account Code No. 001000.270101.6.260, and the Department of Police, Account Code No. 001000.290201.6.260; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. The recommendation of the City Manager to approve the first finding of the Evaluation Committee to accept the proposal of Mercy, pursuant to RFP No. 03-04-059, to perform Drug Screening Services (Part I: Employment Drug Screening Services, and Part II: Sworn Fire Drug Screening Services), for designated personnel for Employee Relations, is accepted. Section 3. The City Manager is authorized{1} to negotiate and execute an Agreement, in substantially the attached form, with Mercy for a two-year period, with the option to renew for two additional one-year periods, at an estimated annual cost not to exceed $30,000, with a cost increase not to exceed 10% effective only during the first one-year renewable period of the contract with no cost increases for the second renewable period, for an estimated total contract amount not to exceed $123,000. Section 4. The recommendation of the City Manager to approve the second finding of the Evaluation Committee to accept the proposal of Preventive Medicine Testing Centers Inc. d/b/a Global MRO ("Global") services for part III, DOT alcohol and controlled substances testing: A. Collection Facility B. Drug Testing Facility and C. MRO Services and Part IV, Sworn Police Drug Screening Services: A. Collection Facility B. Drug Testing Facility and C. MRO services, for designated personnel, for the Department of Employee Relations, is accepted. Section 5. The City Manager is authorized{1} to negotiate and execute an Agreement, in substantially the attached form, with Global for a two-year period with the option to renew for two additional one-year periods, at an estimated annual cost not to exceed $67,375, with a cost increase not to exceed ten percent (10%) effective only during the first one-year renewable period of the contract with no cost increases for the second renewable period, for an estimated total contract amount not to exceed $276,237.50. Section 6. Funds for said services are allocating from the General Operating Budgets of the Department of Employee Relations, Account Code No. 001000.270101.6.260, the Department of Fire -Rescue, Account Code No. 001000.280401.6.260, and the Department of Police, Account Code No. 001000.290201.6.260. Section 7. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.{1} Footnotes: {1} The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
