Chiaro, Interim City Attorney i` DATE: August 31, 2004 RE: Proposed Emergency Ordinance for September 9, 2004 City Commission Meeting Amending Chapter 45 to prohibit unconscionable prices (price gouging) during a declared state of emergency. (File No. 04-01011) The attached, proposed emergency Ordinance amends Chapter 45 of the City of Miami Code, entitled "Public Order," by amending Sections 45-2 and 45-4 and adding new Section 45-8 pertaining to unconscionable prices (price gouging). This Ordinance prohibits unconscionable prices during a declared state of emergency pursuant to Florida Statutes Chapters 252, 870, and 501.160 and Miami -Dade County Code Chapters 8A and 8B. The declaration may be made at the municipal, county, state, and/or federal level. The City already has emergency measures in place during a declared state of emergency pertaining to curfews and prohibitions against ammunition, firearms, alcoholic beverages and improper sale or transfer of combustible liquids, gas, etc. The purpose of this Ordinance is to set measures in place necessary for the protection of life: and property, threatened by man-made, natural, or technological disasters and/or emergencies by preventing price -gouging during a City declared state of emergency.
