A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
AUTHORIZING THE CITY MANAGER TO EXECUTE A REVOCABLE LICENSE
AGREEMENT ("AGREEMENT"), IN SUBSTANTIALLY THE ATTACHED FORM,
WITH FLORIDA POWER & LIGHT COMPANY, A FOR -PROFIT CORPORATION
("LICENSEE"), FOR TEMPORARY USE OF APPROXIMATELY 20,000 SQUARE
FEET OF SPACE WITHIN THE PARKING AREA OF CITY -OWNED PROPERTY
LOCATED AT 3501 RICKENBACKER CAUSEWAY, MIAMI, FLORIDA, ALSO
KNOWN AS MARINE STADIUM, TO BE USED BY LICENSEE'S CONTRACTOR AS
A CONSTRUCTION STAGING AREA TO ASSEMBLE AND STORE THE PIPES TO
RELOCATE THE PIPE TYPE TRANSMISSION LINES UNDER FISHERMAN
CHANNEL; WITH PAYMENT OF A MONTHLY USE FEE TO THE CITY OF MIAMI,
EQUAL TO $5.00 PER SQUARE FOOT OR $8,334, PLUS FLORIDA USE TAX, IF
APPLICABLE; WITH TERMS AND CONDITIONS AS MORE PARTICULARLY SET
FORTH IN THE AGREEMENT.
WHEREAS, the City of Miami ("City") owns the property located at 3501 Rickenbacker
Causeway, Miami, Florida, also known as Marine Stadium ("Property"); and
WHEREAS, the Army Corp of Engineers and the Port of Miami are requiring that Florida Power &
Light Company ("Licensee") relocate two existing high voltage electrical cables to allow for dredging
of the South Channel to Federally designated depths; and
WHEREAS, Licensee has expressed interest in using a portion of the parking area in the Property
to use for a construction staging area to minimize disturbance in the bay for Licensee's contractor to
assemble and store pipes associated with the performance of a job at Fisherman Channel; and
WHEREAS, the City and Licensee desire and intend to enter into a Revocable License
Agreement ("Agreement") for said purpose;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by
reference and incorporated as if fully set forth in this Section.
Section 2. The City Manager is authorized{1} to execute an Agreement, in substantially the
attached form, with Licensee for temporary use of approximately 20,000 square feet of space within
the parking area of the City -owned Property, to be used by Licensee's contractor as a construction
staging area to assemble and store the pipes to relocate the pipe type transmission lines under
Fisherman Channel, with payment to the City of a monthly use fee equal to $5.00 per square foot or
$8,334, plus Florida State Use Tax, if applicable, with terms and conditions as more particularly set
forth in the Agreement.

Section 3. This Resolution shall become effective immediately upon its adoption and signature of
the Mayor.{2}
Footnote
{1} The herein authorization is further subject to compliance with all requirements that may be
imposed by the City Attorney, including but not limited to those prescribed by applicable City
Charter and Code provisions.
{2} This Resolution shall become effective as specified herein unless vetoed by the Mayor
within ten days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall
become effective immediately upon override of the veto by the City Commission or upon the effective
date stated herein, whichever is later.
