Resolution authorizing
execution of a Revocable
License Agreement with Florida
Power & Light Co.

RECOMMENDATION:
The administration recommends that the City Commission adopt the attached Resolution authorizing the
City Manager to execute a Revocable License Agreement (the "Agreement"), in substantially the attached
form, with Florida Power & Light Company, a for profit corporation under the laws of the State of
Florida (the "Licensee"), for the temporary use of approximately 20,000 square feet of City -owned
property located at 3501 Rickenbacker Causeway, Miami, Florida, also known as Marine Stadium (the
"Property"), for the purpose of providing Licensee's contractor a construction staging area to assemble
and store pipes associated with the relocation of the pipe type transmission lines under Fisherman
Channel, with payment of a use fee equal to $5.00 per square foot or $8,334.00 per month plus State of
Florida Use Tax, if applicable.
BACKGROUND:
Florida Power & Light has been requested by the Department of the Army U.S. Corps of Engineers and
the Port of Miami to relocate two existing high voltage electrical cables to allow for the dredging of the
South Channel to Federally designated depths. Florida Power & Light has approached the City for the
use of a portion of City -owned parking area located at the Marine Stadium to use as a construction
staging area to assemble and store the pipes in order to facilitate the project and minimize disturbance in
the bay south of the channel. UTEC Constructors Corporation has been awarded a contract with Florida
Power and Light to relocate the pipe type transmission lines under Fisherman Channel as part of the
dredging of the channel project.
Highlights of the Agreement are as follows:
Use Period: Commences upon the full execution of this Revocable License Agreement and
continues on a month -to -month basis until the first to occur of the following:
(a) cancellation by the by the Licensee; or
(b) revocation by the City.
Utilities: Licensee is responsible.
Fee:
$5.00 per square foot or $8,334.00 per month plus Florida State Use Tax, if
applicable payable upon execution of the agreement.

Late Fee:
5% late fee of the delinquent installment if not received within five days after it
becomes due. After fifteen days past due, unpaid amount to bear interest at 12%
per annum.
Security Deposit: $16,668.00 upon execution of the Agreement.
Maintenance:
Insurance:
Licensee, at its sole cost and expense, may install temporary fencing for the Area.
Licensee shall be responsible for maintaining the Area and shall remove
temporary fencing upon completion of the project.
Licensee is self insured. Licensee will require that its contractor, UTEC
Constructors Corporation, provide the required insurance listing the City as
additional insured, which includes commercial general liability in the amount of
at least $1,000,000 each, automobile liability insurance in the amount of
$500,000, Worker's Compensation in the form and amounts required by State
law.
Financial impact: There is a monthly financial impact of $8,334.00 in revenue to the City's
general fund.
