HomeMy WebLinkAboutR-04-0557City of Miami Legislation Resolution: R-04-0557 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 04-00975 Final Action Date: 9/9/2004 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AUTHORIZING THE CITY MANAGER TO EXECUTE A REVOCABLE LICENSE AGREEMENT ("AGREEMENT"), REVOCABLE AT -WILL, IN SUBSTANTIALLY THE ATTACHED FORM, WITH SPEAK EASY RETURNING TO OUR ROOTS, INC., ALSO KNOWN AS SPEAK EASY TUTORS, A FOR -PROFIT CORPORATION, ("LICENSEE") FOR USE OF APPROXIMATELY 1,167 SQUARE FEET OF SPACE LOCATED AT 1490 NORTHWEST 3RD AVENUE, SPACE NO. 111 IN THE OVERTOWN SHOPPING CENTER, MIAMI, FLORIDA, TO PROVIDE EDUCATIONAL PROGRAMS AND ADMINISTRATIVE OFFICES ON A MONTH -TO -MONTH BASIS, WITH LICENSEE PAYING TO THE CITY OF MIAMI $7.50 PER SQUARE FOOT OR $729.38 PER MONTH, PLUS STATE OF FLORIDA USE TAX OF $51.06, IF APPLICABLE, FOR AN AGGREGATE AMOUNT OF $780.44, WITH TERMS AND CONDITIONS MORE PARTICULARLY SET FORTH IN THE AGREEMENT; FURTHER AUTHORIZING A SIX MONTH ABATEMENT OF THE MONTHLY USE FEE. WHEREAS, the City of Miami ("City") owns certain real property and improvements located at 1490 Northwest 3rd Avenue, Miami, Florida, ("Property"); and WHEREAS, on May 20, 2004, the Overtown Advisory Board recommended approval of the issuance of a Revocable License Agreement ("Agreement") between the City and Speak Easy Returning to Our Roots, Inc. ("Licensee") also known as Speak Easy Tutors, to occupy and use approximately 1,167 square feet of space at the Property, Space No. 111; and WHEREAS, the City Commission is committed to economic development within target areas of the City and specifically the continued development of the City -owned Overtown Shopping Center; and WHEREAS, Motion No. 97-776, adopted October 28, 1997, granted a six-month use fee abatement to all businesses paying user fees to the City at the Overtown Shopping Center; and WHEREAS, the City and the Licensee desire to enter into an Agreement to administer and implement educational program offices in the Overtown community; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Manager is authorized{1} to execute an Agreement, revocable at -will, in City of Miami Page 1 of 2 File Id: 04-00975 (Version: 1) Printed On: 9/30/2016 File Number: 04-00975 Enactment Number: R-04-0557 substantially the attached form, with Licensee, a for -profit corporation, for use of approximately 1,167 square feet of space in the Overtown Shopping Center Property, Space No. 111, to provide educational programs and administrative offices on a month -to -month basis, with Licensee paying $7.50 per square foot or $729.38 per month, plus a State of Florida Use Tax of $51.06, if applicable, for an aggregate amount of $780.44, with terms and conditions more particularly set forth in the Agreement. Section 3. A six-month abatement of the monthly Use fee, is authorized. Section 4. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.{2} Footnotes: {1} The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
