A RESOLUTION OF THE MIAMI CITY COMMISSION, RESCINDING THE BID
AWARDED TO PRIT, INC. D/B/A U.S. LAWNS OF MIAMI TO PROVIDE GROUNDS
MAINTENANCE SERVICES, PURSUANT TO RESOLUTION NO. 03-415,
ADOPTED MAY 6, 2003, FOR FAILURE TO PERFORM AS CITED IN SECTION 3.25
OF BID CONTRACT NO. 02-03-015; AMENDING RESOLUTION NO. 03-415, TO
REFLECT SAID CHANGE.
WHEREAS, after receipt of numerous complaints from the Departments of Public Facilities and
Parks and Recreation regarding the poor quality of service provided by PRIT, Inc. d/b/a U.S. Lawns of
Miami, the Department of Purchasing ("Purchasing") has determined that PRIT, Inc. d/b/a U.S. Lawns
of Miami is in breach of contract, in particular, Section 3.25, of the Bid Contract, by not performing in
full accordance with the specifications as cited in the Invitation For Bid, the City of Miami is exercising
its right to terminate said contract; and
WHEREAS, to avoid interruption of services at the facilities currently maintained by PRIT, Inc.
d/b/a U.S. Lawns of Miami, the Purchasing has solicited quotes from two vendors, under Bid No. 02-
03-015 and Bid No. 00-01-071, exercising the option to add facilities, as allowed by the contract
provisions;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The bid awarded to PRIT, Inc. d/b/a/ US Lawns of Miami, pursuant to Resolution No.
03-415, adopted May 6, 2003, to provide grounds maintenance services, is rescinded, for failure to
perform as cited in Section 3.25 of Bid Contract No. 02-03-015.
Section 2. Resolution No. 03-415 is amended in the following particulars:{1}
"Resolution No. 03-415
Section 1. The bids of Tropical Evergreen Landscaping, and PRIT, Inc. d/b/a U.S.
Lawns of Miami, for the provision of grounds maintenance services, to be utilized by
various user departments and agencies, on a contract basis for a two-year period, with
the option to renew for two additional one-year periods, at an estimated annual amount
of $115,980, are is accepted, subject to increases as required due to the addition of
new facilities , with funds allocated from the Operating Budgets of the various user
departments and agencies individual departmental accounts, subject to availability of
funds.

Section 3. This Resolution shall become effective immediately upon its adoption and signature of
the Mayor.{2}
Footnotes:

shall be added. The remaining provisions are now in effect and remain unchanged. Asterisks
indicate omitted and unchanged material.
{2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar
days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become
effective immediately upon override of the veto by the City Commission.
