AN ORDINANCE OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
APPROVING THE ESTABLISHMENT OF CRITERIA AND A SELECTION PROCESS,
ATTACHED AND INCORPORATED, TO FACILITATE THE AWARD OF
SCHOLARSHIPS FROM THE CITY OF MIAMI DEPARTMENT OF SOLID WASTE'S
RECYCLING AND EDUCATIONAL TRUST FUND, ESTABLISHED THROUGH
CHAPTER 22, SECTION 22-15 ENTITLED "EDUCATIONAL TRUST FUND;"
CONTAINING A REPEALER PROVISION, A SEVERABILITY CLAUSE AND
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, Ordinance No. 10654, adopted October 12, 1989, amended Chapter 22 of the City
Code which established an Educational Trust Fund from monies received by the City of Miami ("City")
from the recycling of newspapers and other salvageable materials; and
WHEREAS, the funds were to be maintained in an interest bearing account and upon the
accumulation of $1,000,000 in funds received in this manner, the interest was to be used to pay 10,
or a lesser amount of full scholarships to college level educational institutions to be awarded annually
by the City Commission to children of employees of the General Services Administration Department,
which at that time included the Solid Waste Division; and
WHEREAS, Ordinance No. 12258, adopted July 24, 2002, amendments were made to Chapter
22, specifically Section 22-15, the Educational Trust Fund, which re-established the Department of
Solid Waste as a separate department; and
WHEREAS, this Ordinance proposes that the City Commission approve the attached criteria and
selection process developed by the Department of Solid Waste ("Solid Waste") and allow for a
competitive process, selection and award of scholarships from the Recycling and Educational Trust
Fund annually; and
WHEREAS, as a result of said approval the appropriate administrative actions will facilitate and
ensure that said appropriations are allocated;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Ordinance are adopted by
reference and incorporated as if fully set forth in this Section.
Section 2. The establishment of criteria and a selection process, attached and incorporated, to
facilitate the award of scholarships from the Solid Waste's Recycling and Educational Trust Fund,
established through Chapter 22, Section 22-15, entitled "Educational Trust Fund;" is approved.
Section 3. All Ordinances or parts of Ordinances insofar as they are inconsistent or in conflict with

the provisions of this Ordinance are repealed.
Section 4. If any section, part of section, paragraph, clause, phrase or word of this Ordinance is
declared invalid, the remaining provisions of this Ordinance shall not be affected.
Section 5. This Ordinance shall be come effective thirty (30) days after final reading and adoption
thereof.{1 }

{1} This Ordinance shall become effective as specified herein unless vetoed by the Mayor within ten
days from the date it was passed and adopted. If the Mayor vetoes this Ordinance, it shall become
effective immediately upon override of the veto by the City Commission or upon the effective date
stated herein, whichever is later.
