FERNANDEZAS CITY ATTORNEY OF THE CITY OF MIAMI, FLORIDA, WITH AN EFFECTIVE DATE AND WITH COMPENSATION AND EMOLUMENTS TO BE DETERMINED BY THE CITY COMMISSION. WHEREAS, the City Charter provides that the City Commission shall elect and appoint a City Attorney; and WHEREAS, pursuant to Resolution No. 04-0305, adopted May 6, 2004, the City Commission established a six (6) member Selection Advisory Committee ("Committee") to review applications, conduct personal interviews of candidates for this position, and to recommend no less than three and no more than five qualified individuals to the City Commission for consideration; and WHEREAS, the Committee has presented its recommendation and it is now incumbent upon the City Commission to elect and appoint an individual as City Attorney of the City of Miami, Florida; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. Jorge L. Fernandez is elected and appointed as City Attorney of the City of Miami, Florida, with an effective date and with compensation and emoluments to be determined by the City Commission. Section 3. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.{1} Footnotes: {1} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
