FIRST AMENDMENT TO CONTRACT
"ROAD REHABILITATION PROJECT, B-4651"
This first Amendment to the Contract for "Road Rehabilitation Project" between the Contractor and the
City, authorized by the City Commission Resolution No. , dated _2004
which is deemed as being incorporated by reference as if set for in full herein, is entered into this
day of , 2004, by and between the City of Miami, a municipal corporation of the
State of Florida (the "City"), and Petro Hydro, Inc., a Florida corporation ("Contractor') for the purpose
of amending that certain Contract dated September 2, 2003, between the City and the Contractor (the
"Contract") as set forth herein.
RECITALS:
WHEREAS, pursuant Resolution No. 03-752, adopted by the City Commission on July 17, 2003,
the City and the Contractor entered into the Contract for the furnish of all labor, materials and equipment
and perform all the work as provided in the attachment "A" and other Contract documents for the project
entitled "Road Rehabilitation Project, B-4651"; and
WHEREAS, the Resolution No. , adopted by the City Commission on
, 2004 authorized: 1)- to extend the construction along the 35th Street
from NW 25th Avenue to NW 276 Avenue; 2)- to increase the amount of compensation from $737,543.05
to $1,002,709.21; 3)- to extend the construction time (60) Sixty calendar days from (150) One Hundred
Fifty calendar days to (210) Two Hundred Ten calendar days, and 4)- to sign the First Amendment to the
Contract with Petro Hydro Inc.
NOW THEREFORE, in consideration of the foregoing and of the mutual agreements and
covenants of the parties as set forth in the Contract, the City and the Contractor agree as follows:
1. Location: The NW 35th Street from NW 25th Avenue to NW 27th Avenue is hereby included
in the Contract.
2. Term: The term of the Contract is hereby -extended (60) Sixty -calendar day, beginning (150)
One -Hundred Fifty calendar day completion time stipulated in the Contract.
3. Compensation: Article 2 of the Contract is hereby amended to increase the amount of
compensation from $737,543.05 to $1,002,709.21. Except as provided herein, no other
compensation, fee, reimbursable expense or charge shall be payable by the City.
Except as specifically provided herein, all of the terms and provisions of the Construction Contract
shall remain in operative force and effect.
