ANALYSIS FOR ZONING CHANGE
Approximately 3804-3820 NW 12th Avenue.
CASE NO: 2004-033
Pursuant to Article 4, Section 401 of Ordinance 11000, as amended, the Zoning
Ordinance of the City of Miami, Florida, the subject proposal for an amendment to the
Zoning Atlas has been reviewed as follows:
The request is to change the Zoning designation as follows:
The subject property consists of one lot facing NW 12th Avenue (Complete legal
description on file at the Hearing Boards Office), from R-2 "Two Family Residential" to
C-2 "Liberal Commercial".
The following findings have been made:
• -It is found that a the companion item for this petition changing the Land Use
designation was presented and recommended for approval at the PAB meeting of
March 31, 2004, Item #1.
• It is found that the. subject parcel is a remnant land between NW 39th Street, NW 12th
Avenue and the Metrorail.
• It is found that the character of NW 12th Avenue in this area is not residential.
• It is found that a duplex use on this parcel would not be appropriate because of the
noise, and the exposure of the site that result in a dangerous location for residential
uses.
• It is found that the change to C-2 `Liberal Commercial" is a logical designation
because that use has been existing grandfathered on that parcel for a long time, and
will not constitute an intrusion of commercial activities into a well defined duplex
residential area.
Based on these findings, the Planning and Zoning Department is recommending
approval of the application as presented.
